REGULAR MEETING DECEMBER 4, 1972 ' <br />RESOLUTIONS (CONTINUED) <br />Councilman Kopczynski said that, as a city, we are charged with keeping order on public property <br />and in public places. The property owner has the legal right to protect his property as he sees <br />fit. He said the resolution does not ask for any money at the present time, but would allow the <br />Council to explore legislation at the city, state and federal level to aid victims. Councilman <br />Kopczynski then moved for adoption of the resolution. There was no second to the motion. Council <br />man Miller moved to strike the resolution from the files, seconded by Councilman Horvath. The <br />motion carried by a roll call vote of eight ayes (Councilmen Serge, Szymkowiak, Miller, Parent, <br />Taylor, Horvath, Newburn and Nemeth) one nay (Councilman Kopczynski). <br />ORDINANCES, FIRST READING <br />ORDINANCE AN ORDINANCE FOR AN ADDITIONAL APPROPRIATION IN THE <br />AMOUNT OF $34,000.00 FROM THE GENERAL FUND TO "PARKING <br />GARAGE FUND PROJECT - 1969" <br />This ordinance had first reading. Councilman Parent made a motion that the rules be suspended <br />and the public hearing and second reading of the ordinance be held at this time. Councilman <br />Miller seconded the motion and it carried unanimously. Mr. James Barcome, City Controller, said <br />that this appropriation is needed to make the payment on the bond obligation for the parking <br />garages. They have been able to generate more revenue from the garages and have developed several <br />flat lots and anticipate an increase in revenue so that this situation should not occur again. <br />Money which has been paid in parking violationsfines has been paid into the General Fund and it <br />is this money that is being appropriated by the ordinance. Miss Virginia Guthrie, Executive <br />Secretary of the Civic Planning Association, said that they object strongly to this appropriation. <br />She said that when the parking garages were proposed, assurance was given that no property tax <br />money would be needed for them. Mrs. Janet Allen, 125 West Marion, agreed with Miss Guthrie that <br />this money should not be appropriated for the parking garages. Mr. Glen Voreis, 214 E. Ewing <br />Avenue, said he objected to the principle of the appropriation, since it appears an error was made <br />by the consulting firm in calculating the amount of revenue to be produced by the parking <br />structures. <br />The ordinance had second reading. Councilman Parent made a motion that the ordinance pass, <br />seconded by Councilman Miller. The ordinance passed by a roll call vote of eight ayes (Councilmen <br />Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Newburn and Nemeth) one nay (Councilman <br />Horvath). <br />ORDINANCE AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE <br />NO. 4990 -68, CHAPTER 21 OF THE MUNICIPAL CODE OF <br />THE CITY OF SOUTH BEND, INDIANA FORMERLY CHAPTER <br />40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA AND REFERRED TO AS ZONING ORDINANCE NO. <br />3702 AS AMENDED. (EAST OF ST. JOSEPH RIVER BORDERING <br />DOWNTOWN AREA) <br />This ordinance had first reading. Councilman Newburn made a motion that the ordinance be referred <br />to the Area Plan Commission for their study and recommendation. Councilman Taylor seconded the <br />motion and it was carried. <br />ORDINANCE AN ORDINANCE FOR A TRANSFER IN THE AMOUNT OF $100.00 <br />TO ACCOUNT Y -361, "RECORDS, STATIONERY AND PRINTING ", <br />FROM ACCOUNT Y -213, "TRAVELING EXPENSES" IN THE AMOUNT <br />OF $50.00, AND FROM ACCOUNT Y -252, "REPAIRS OF EQUIPMENT" <br />IN THE AMOUNT OF $50.00, ALL ACCOUNTS BEING WITHIN THE <br />FIREMEN'S PENSION.'FUND. <br />This ordinance had first reading. Councilman Miller moved that the rules be suspended and the <br />public hearing and second reading be held at this time. The motion was seconded by.- Councilman <br />Newburn and carried unanimously. Captain Ernest Rozanski, Secretary of the Firemen's Pension <br />Fund, explained that the State Board of Accounts has asked them to change their system of record <br />keeping and the money is nedded to buy ledgers. Councilman Miller made a motion that the <br />ordinance pass, seconded by Councilman Szymkowiak. The ordinance passed by a roll call vote of <br />nine ayes (Councilmen Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, Horvath, Newburn and <br />Nemeth). <br />ORDINANCE AN ORDINANCE FOR A TRANSFER IN THE AMOUNT OF $80.00 TO <br />ACCOUNT Q -43 "REPAIR PARTS" FROM ACCOUNT Q -11 "SERVICES <br />PERSONAL" IN THE FIRE DEPARTMENT BUDGET, ALL BEING <br />WITHIN THE GENERAL FUND. <br />This ordinance had first reading. Councilman Miller made a motion to suspend the rules and hold <br />the public hearing and second reading on the ordinance at this time. Councilman Newburn seconded <br />the motion and it was carried unanimously. Assistant Fire Chief Joseph V. Nagy explained that <br />they are asking for this transfer from Q -11 to Account Q -43 "Repair Parts' which is depleted. <br />There was a breakdown of a piece of equipment and the money is needed to pay for the part. Miss <br />Virginia Guthrie, Executive Secretary of the Civic Planning Association, asked what part was <br />needed. Chief Nagy said that they purchased a clutch to get the vehicle back into service. They <br />had no choice if they wanted to get the vehicle out of the garage. Councilman Szymkowiak made a <br />motion that the ordinance pass, seconded'-by Councilman Kopczynski. The ordinance passed by a <br />roll call vote of nine ayes (Councilmen Serge, Szymkowiak, Miller, Parent, Taylor, Kopczynski, <br />Horvath, Newburn and Nemeth). <br />ORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE WASTEWATER <br />TREATMENT PLANT OF THE CITY OF HOUTH BEND, INDIANA AND RIES <br />EQUIPMENT COMPANY, INDIANAPOLIS, INDIANA, FOR THE PURCHASE <br />OF TWO SELF - PROPELLED VACUUM TYPE STREET SWEEPERS IN THE <br />AMOUNT OF $65,460.00. <br />This ordinance had first reading. Councilman Taylor moved that the ordinance be set for public <br />hearing and second reading on December 18, 1972,.' Councilman Miller seconded the motion and it <br />carried. <br />
