REGULAR MEETING DECEMBER 17, 1979 <br />REGULAR MEETING RECONVENED (CONTINUED <br />RESOLUTION NO. 746 -79 <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA APPROVING A LEASE BETWEEN THE BOARD OF <br />PUBLIC WORKS AND MICHIGAN - MARION STREET JOINT VENTURE FOR <br />A PARCEL OF LAND LOCATED AT THE SOUTHWEST CORNER OF <br />MICHIGAN STREET AND MARION STREET, FROM JANUARY 1, 1980 <br />THROUGH DECEMBER 31, 1984. <br />WHEREAS, the Common Council of the City of South Bend has passed an ordinance stipulating <br />that the lease of any city -owned real estate to a non- governmental agency entered into by the <br />Board of Public Works shall be submitted to the Common Council for approval, and <br />WHEREAS, the Board of Public Works has entered into a lease with Michgian - Marion Street <br />Joint Venture for use of a parcel of land located at the southwest corner of Michigan Street <br />and Marion Street, from January 1, 1980 . through December 31, 1984, which lease agreement was <br />approved by the Board of Public Works on December 17, 1978, a copy of which is attached <br />hereto. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: <br />SECTION I. That the lease between the Board of Public Works and Michigan- Marion Street <br />Joint Venture for the parcel of land located at the southwest corner of Michigan Street and <br />Marion Street, entered into on December 17, 1979, is hereby approved. <br />SECTION II. This Resolution shall be in full force and effect from and after its adoption <br />by the Common Council and approval by the Mayor. <br />/s/ Roger 0. Parent <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Mr. Patrick McMahon, Director of <br />Public Works, indicated that this was a five year lease, for $800 per year, and all improve- <br />ments will be made by the leasee. He said at the end of five years this lease may be terminated <br />and the City would receive all improvements. Council Member Szymkowiak made a motion to adopt <br />this resolution, seconded by Council Member Miller. Council Member Adams made a motion to <br />amend the resolution by adding that all improvements upon said property could not exceed <br />$8,000. The motion failed for lack of a second. The motion to adopt passed by a roll call <br />vote of eight ayes and one nay (Council Member Adams.) <br />BILLS, FIRST.READING <br />ORDINANCE NO. 6723 -79 <br />AN ORDINANCE APPROVING THE FORM AND TERMS OF LEASE AND TRUST <br />INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND <br />AUTHORIZING THE EXECUTION THEREOF, AND APPROVING RESOLUTION <br />NO. 42 -79 OF THE SOUTH BEND ECONOMIC DEVELOPMENT COMMISSION <br />RELATING TO THE GEORGE E. ROSS, ROBERT C. ROSS AND RICHARD <br />C. ROSS PROJECT. <br />This bill had first reading. Council Member Taylor made a motion to suspend the rules and have <br />public hearing and second reading on this bill, seconded by Council Member Dombrowski. The <br />motion carried by a roll call vote of nine ayes.. This being the time heretofore set for public <br />hearing on the above bill, proponents and opponents were given an opportunity to be heard. <br />Mr. Kenneth Fedder, attorney for the Economic Development Commission, made the presentation <br />for the bill. He said this was a supplement issue of $40,000 to complete the facilities <br />located at 406 E. Monroe. Council Member Miller made a motion to pass this bill, seconded by <br />Council Member Dombrowski. The bill passed by a roll call vote of nine ayes. <br />BILL NO. 199 -79 A BILL APPROVING THE FORM AND TERMS OF TRUST INDENTURE AND <br />USER AGREEMENT, REAL ESTATE MORTGAGE AND INDUSTRIAL DEVELOP - <br />MENT REVENUE BONDS, AND AUTHORIZING THE EXECUTION THEREOF <br />AND APPROVING RESOLUTION NO. 40 -79 OF THE SOUTH BEND ECONOMIC <br />DEVELOPMENT COMMISSION RELATING TO THE SAM COSSMAN AND <br />VIRGINIA COSSMAN PROJECT. <br />This bill had first reading. Council Member Kopczynski made a motion to set this bill for <br />public hearing and second reading January 14, 1980, seconded by Council Member Adams. The <br />motion carried. <br />BILL NO. 200 -79 A BILL APPROPRIATING $24,000.00 FROM THE FEDERAL ASSISTANCE <br />GRANT, COMMONLY KNOWN AS GENERAL REVENUE SHARING, TO FUND <br />THE POSITION OF SAFETY BOARD ASSISTANT, TO BE ADMINISTERED <br />BY THE CITY OF SOUTH BEND THROUGH ITS DEPARTMENT OF LAW. <br />This bill had first reading. Council Member Kopczynski made a motion to set this bill for <br />public hearing and second reading January 14, 1980, seconded by Council Member Dombrowski. <br />The motion carried. <br />BILL NO. 201 -79 A BILL APPROPRIATING $24,100.00 FROM THE FEDERAL ASSISTANCE <br />GRANT COMMONLY REFERRED TO AS GENERAL REVENUE SHARING, FOR <br />DOG ENFORCEMENT PERSONNEL, TO BE ADMINISTERED BY THE CITY OF <br />SOUTH BEND THROUGH ITS MAYOR`ACTION CENTER. <br />This bill had first reading. Council Member Taylor made a motion to set this bill for public <br />hearing and second reading January 14, 1980, seconded by Council Member Dombrowski. The <br />motion carried. <br />
