REGULAR MEETING SEPTEMBER 27 1976 <br />COMMITTEE OF THE WHOLE MEETING (CONTINUED) <br />Council President Parent asked the Council attorney if he could refuse to vote. Kathy Cekanski, <br />Council attorney, indicated he could. The motion carried. Council Member Taylor made a motion <br />that this ordinance be recommended favorably to the Council, as amended, seconded by Council <br />Member Dombrowski. The motion carried, with Council Member Kopczynski abstaining. <br />ORDINANCE AN ORDINANCE APPROVING THE FORM AND TERMS OF LEASE <br />AND TRUST INDENTURE AND ECONOMIC DEVELOPMENT REVENUE <br />BONDS, AND AUTHORIZING THE EXECUTION THEREOF PERTAINING <br />TO BENEDICT R. LEYBA AND ELSIE M. LEYBA,, HUSBAND AND <br />WIFE; STEVEN M. SULENTIC AND DONNAREA M. SULENTIC, <br />HUSBAND AND WIFE; AND DUANE D. BEVIS. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and op- <br />ponents were given an opportunity to be heard. Mr. Kenneth Fedder, attorney, made the presenta- <br />tion for the ordinance. He indicated the Economic Development Commission had approved this. He <br />said they presently had a business in the City which they would continue to operate, however, <br />they were going to build a new business in Industrial Park He said this was an expansion of th <br />tax base and additional employment in our community. Council Member Szymkowiak asked if they <br />were going to operate the new business the same as they were operating the business on Werwinski <br />St., and if they were he felt sorry for the Industrial Park. He indicated they were in violation <br />of the City ordinance on Olive st., and in general they had messy housekeeping. Mr. Jack Dunfee <br />attorney for Acra Tire, indicated there was no offstreet parking on Werwinski, and there would <br />be adequate parking in the Industrial Park. He indicated that there had been four hearings re- <br />garding the fence on Olive St., and there has been no order issued to remove the fence, and in <br />his opinion the fence is not a violation of the law. He indicated that there would be no messy <br />housekeeping in the Industrial Park, since it was not allowed. Council Member Kopczynski said <br />that Mr. Dunfee had alluded to the fact that they will operate their,business differently in the <br />Industrial Park because someone is making sure they do, and does this mean the City is not en- <br />forcing the law. He wanted to know who enforced the law in Industrial Park. He was informed <br />that Industrial Park does its own enforcing. Council Member Miller made a motion that this <br />ordinance be recommended to the Council favorably, seconded by Council Member Serge. The motion <br />carried. <br />ORDINANCE AN ORDINANCE APPROPRIATING $705,000 FROM <br />THE COMMUNITY DEVELOPMENT FUND, FOR HOUSING <br />REHABILITATION PROGRAM, TO BE ADMINISTERED <br />BY THE CITY OF SOUTH BEND THROUGH ITS BUREAU <br />OF HOUSING <br />This being the time heretofore set for public hearing on the above ordinance, proponents and op- <br />ponents were given an opportunity to be heard. Mr. Keith Crighton, Director of the Bureau of <br />Housing, made the presentation for the ordinance. He said this $705,000 is the major part of <br />the City's abatement of urban blight in four target areas that have demonstrated a need for <br />neighborhood preservation. Mrs. Jane Swan, 2022 Swygart, questioned Mr. Crighton regarding the <br />qualifications to receive this aid. Council Member Adams asked how a violation in an assistance <br />program is dealt with. Mr. Crighton indicated that suit would be brought against the violator. <br />Council Member Serge asked for a list of homes that have been rehabilitated. Council Member <br />Adams made a motion that this ordinance be recommended to the Council favorably, seconded by <br />Council Member Serge. The motion carried. <br />ORDINANCE AN ORDINANCE APPROPRIATING $40,000 FROM <br />THE COMMUNITY DEVELOPMENT FUND, FOR NON- <br />PROFIT HOUSING REHABILITATION PROGRAM, TO <br />BE ADMINISTERED BY THE CITY OF SOUTH BEND <br />THROUGH ITS BUREAU OF HOUSING. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and op- <br />ponents were given an opportunity to be heard. Mr. Keith Crighton, Director of the Bureau of <br />Housing, made the presentation for the ordinance. He said this appropriation was for non - profit <br />group rehabilitation of homes. He indicated that non - profit groups have demonstrated a desire <br />to rehabilitate residential structures and are able to receive funding. He asked that the guide- <br />lines be amended in Grant Qualification Processing by adding.a sentence to read "In no instance <br />shall the cash grant be used to purchase real property ". Council Member Taylor made a motion to <br />incorporate that in the guidelines, seconded by Council Member Adams. The motion carried. <br />Council Member Horvath questioned the last sentence of the guidelines which read "Money remaininl <br />in the account after final inspection shall belong to the non - profit group. Mr. Crighton in- <br />dicated that many times there will be a balance of $20 or $30, and because they are a non - profit <br />group it has been determined that small balances should be returned to their account. Council <br />Member Horvath indicated that it would be better for the money to revert to the rehabilitation <br />program. Council Member Dombrowski asked what type of groups would qualify under this program. <br />Mr. Crighton indicated Renew, Inc., Southhold, or any neighborhood organization. Council Member <br />Dombrowski made a motion that this ordinance be recommended to the Council favorably, as amended, <br />seconded by Council Member Parent. Council Member Parent made a motion to add to the last sen- <br />tence "for use in the rehabilitation of homes ", seconded by Council Member Serge. Council Member <br />Adams indicated she had a problem with the word belong, and she would like, may be used, and if <br />it is not used within a year it would revert back to the Community Development Program for use <br />in the rehabilitation of homes. She asked Council President Parent to withdraw his motion in <br />order that she could make a motion. Council President Parent withdrew his motion, and Council <br />Member Serge withdrew his second. Council Member Adams made a motion to add the following to <br />the last sentence "for further housing rehabilitating. If it is not used within one year it wil: <br />revert back to the Community Development Program. Council President Parent seconded the motion. <br />The motion carried. The motion to send this to Council favorably carried. <br />ORDINANCE AN ORDINANCE TRANSFERRING $46,000 IN THE <br />GENERAL PARK FUND. ALL TRANSFERS ARE <br />BEING MADE IN VARIOUS BUDGET CLASSIFICA- <br />TIONS WITHIN THE GENERAL PARK FUND. <br />
