REGULAR MEETING <br />REGULAR MEETING - RECONVENED (CONTINUED) <br />JULY 19, 1976 <br />I, the undersigned, do hereby respectfully make application and petition the Common Council <br />of the City of South Bend to amend the Zoning Ordinance of the City of South Bend as herein- <br />after requested, and in support of this application, the following facts are shown: <br />1. The property sought to be rezoned is located at <br />S/E corner of St. Joseph Street and Ireland Road <br />2. The property is owned by <br />Dr. Elmer Graber <br />3. A legal description of the property is as follows: <br />A part of the North one -half of the Southwest Quarter of Section 25, <br />Township 37 North, Range 2 East described as beginning at a point <br />918.56 feet East of the intersection of the East line of the Michigan <br />Road and the South line of Ireland Road in the North half of the <br />Southwest Quarter of said Section 25; running thence South 300 feet; <br />thence West 177.2 feet; thence North 300 feet; thence East 177.2 feet <br />to the place of beginning and being known as Lot Numbers 11 & 12 <br />in a proposed plat of said North half of the Southwest Quarter of <br />Section 25, Township 37 North, Range 2 East. Subject to legal highways. <br />4. It is desired and requested that the foregoing property be rezoned <br />From "C" Commercial and "A" Use and A Height and Area District <br />to "C" Commercial Use and A Height and Area District <br />5. It is proposed that the property will be put to the following use and the following <br />building will be constructed <br />1 building containing an Arthur Treacher's Fish & Chip Restaurant <br />6. The property is owned by Max Koenig, Ina Rosenberg, Irving Rosenberg and Elaine Koenig. <br />3. A legal description of the property is as follows: <br />Fifty -five (55) feet taken off of and from the West end of <br />Lots One Hundred Twenty -one (121), One Hundred Twenty -two <br />(122) and One Hundred Twenty -three (123) of the Original <br />Plat of the Town, now City of South Bend, in St. Joseph <br />County, Indiana, together with the vacated 14' alley lying <br />west of and adjoining said lots. <br />4. It is desired and requested that the foregoing property be rezoned: <br />From B Residential Use and B Height and Area District <br />To C Commercial Use and F Height and Area District <br />5. It is proposed that the property will be put to the following use and the following build- <br />ing will be constructed: One story warehouse, 96 feet by 140 feet. <br />6.
