REGULAR MEETING SEPTEMBER 22, 1975 <br />COMMITTEE OF THE WHOLE MEETING (CONTINUED <br />ORDINANCE AN ORDINANCE TRANSFERRING THE SUM OF. <br />$9,550.00 BETWEEN VARIOUS ACCOUNTS IN <br />THE CUMULATIVE CAPITAL IMPROVEMENT FUND <br />OF THE CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above ordinance, proponents and <br />opponents were given an opportunity to be heard. Mr. David Wells, Manager of the Bureau of Design <br />and Administration, made the presentation for the ordinance. He indicated that the funds would be <br />used to pay for the land at Fire Station No. 4 which was a debt owed to the Redevelopment <br />Department. He submitted to the Council members material concerning the cost of the station. <br />Councilman Miller wondered if the Council would have to approve the purchase of the land in addi- <br />tion to the transfer of funds. Mr. Wells indicated that, by appropriating the money, the Council <br />was giving its approval for the purchase. Councilman Miller wondered if there was any plan at <br />the present time for anything additional to be constructed on the land. He felt the total uses of <br />the land should be considered. He wondered if the land would have to be tied up for a fire <br />station. Mr. Wells indicated that he was not aware of that. Councilman Szymkowiak talked about <br />the procedure used in acquiring the land and building the station. He disagreed with the practice <br />followed. <br />Councilman Miller made a motion that the ordinance be recommended favorably.to the Common Council, <br />seconded by Councilman Serge. The motion carried. <br />There being no further business to come before the Committee of the Whole, Councilman Horvath <br />made a motion to rise and report to the Council, seconded by Councilman Miller. The motion <br />carried. <br />ATTEST: <br />CITY CLERK <br />REGULAR MEETING - RECONVENED <br />Be it remembered that the regular meeting of the Common Council of the City of South Bend <br />reconvened in the Council Chambers at 7:35 p.m,., Council President Parent presiding and Counci <br />Kopczynski absent. <br />REPORT FROM THE SUB - COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />Your sub - committee on the inspection and supervision of the minutes <br />would respectfully report that it has inspected the minutes of the <br />September 8, 1,975, regular meeting of the Council and found them correct. <br />The sub- committee, therefore, recommends that the same be approved. <br />s/ Roger O. Parent <br />Councilman Miller made a motion to accept the report as read and place it on file and approve the <br />minutes, seconded by Councilman Taylor. The motion carried. <br />REPORT FROM THE COMMITTEE OF THE WHOLE <br />Councilman Newburn made a motion to waive the reading of the report of the Committee of the Whole, <br />seconded.by Councilman Taylor. The motion carried by a roll call vote of eight ayes (Councilmen <br />Serge, Szymkowiak, Miller, Taylor, Horvath, Nemeth, Newburn and Parent) with Councilman Kopczynski <br />absent. <br />REPORT FROM THE AREA PLAN COMMISSION (southeast corner of Thomas and Walnut) <br />The Honorable Common Council <br />City of South Bend <br />County -City Building <br />South Bend, Indiana 46601 <br />September 17, 1975 <br />In Re: A proposed ordinance and site development plan of Richard L. Kennedy <br />to zone from "A" Residential, "A" Height and Area, to "C" Commercial, <br />"E" Height and Area, property located at the southeast corner of <br />Thomas and Walnut Streets, City of South Bend <br />Gentlemen: <br />The attached rezoning petition of Richard L. Kennedy was legally advertised <br />September 6 and September 13, 1975. The Area Plan Commission gave it a public hearing <br />on September 16, 1975, at which time the following action was taken: <br />"Upon a motion by Kenneth Woods, being seconded by Garrett Mullins <br />and unanimously carried, the petition of Richard L. Kennedy to zone <br />from "A" Residential, "A" Height and Area, to "C" Commercial, "E" <br />Height and Area, property located at the southeast corner of Thomas <br />and Walnut Streets, City of South Bend, is returned to the Common <br />Council with a favorable recommendation, subject to a final site plan, <br />by the Area Plan Commission." <br />The above recommendation is made subject to a final site plan and the preliminary <br />site plan is attached hereto. <br />The deliberations of the Area Plan Commission and points considered in arriving <br />at the above decision are shown in minutes of that public hearing and will be forwarded <br />to you at a later date to be made a part of this report. Attached for your considera- <br />tion in the review of this matter is the Area Plan Commission staff report. <br />
