REGULAR MEETING AUGUST 11, 1975 <br />REGULAR MEETING - RECONVENED (CONTINUED) <br />RESOLUTION NO. 493 -75 (CONTINUED) <br />WHEREAS, the form and terms of said lease between the City and the Authority, <br />including those terms set out above, now meet the approval of the Common Council of <br />the City. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, that: <br />SECTION I. The form and terms of the lease between the Authority and the City, <br />marked "Exhibit B" and attached hereto are hereby approved. <br />SECTION II. This resolution shall be in full force from and after its passage <br />by the Common Council and approval by the Mayor. <br />s/ Terr 'S'. Miller <br />Member of the Common Council <br />A public hearing was held at this time on the resolution. Mr. Patrick McMahon, Manager of the <br />Bureau of Public Construction, indicated that the resolution also referred to an ordinance which <br />was having first reading at the Council meeting. He stated that adoption of the resolution.would <br />approve the form of a lease between the City of South Bend and the Building Authority during the <br />bond sale and retirement of the bonds. The lease stated that the Building Authority would con- <br />struct a portion of the Civic Center. The costs were identified and it would be agreed that the <br />National Bank and Trust Company would serve as the trustee. He stated that the principle terms o <br />the lease provided that the city would lease a portion of the building to the authority; that the <br />authority's responsibility would be within a limit in incurring costs; that the authority would <br />construct its improvement at the site; that the authority would be required to maintain proper <br />insurance of contractors; that, upon the building completion, the authority would lease back its <br />improvements for a period of 25 years for an annual lease of $456,000; and that certain options <br />were included for the purchase of improvements, and default provisions were also included. <br />Councilman Serge made a motion to adopt the resolution, seconded by Councilman Newburn. The <br />resolution was adopted by a roll call vote of eight ayes (Councilmen Serge, Szymkowiak, Miller, <br />Taylor, Kopczynski, Horvath, Nemeth and Newburn) with Councilman Parent absent. <br />ORDINANCES, FIRST READING <br />ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, <br />AS AMENDED, COMMONLY KNOWN AS THE ZONING <br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA <br />(CHAPTER 21, MUNICIPAL CODE) - southeast <br />corner of Thomas and Walnut Streets. <br />This ordinance had first reading. Councilman Nemeth made a motion to refer the ordinance, along <br />with the petition, to the Area Plan Commission, seconded by Councilman Kopczynski. The motion <br />carried. <br />ORDINANCE AN ORDINANCE APPROPRIATING $3,400.00 FROM <br />THE FEDERAL ASSISTANCE GRANT, COMMONLY <br />REFERRED TO AS GENERAL REVENUE SHARING, <br />FOR THE REVISION OF THE SOUTH BEND <br />MUNICIPAL CODE, TO BE ADMINISTERED BY <br />THE,CITY OF SOUTH BEND THROUGH ITS LAW <br />DEPARTMENT. <br />This ordinance had first reading. Councilman Nemeth made a motion to set the ordinance for publi <br />hearing and second reading on August 254 1975, seconded by Councilman Miller. The motion carried. <br />ORDINANCE AN ORDINANCE APPROPRIATING THE SUM OF <br />$100,000.00 FROM THE SEWAGE WORKS <br />IMPROVEMENT FUND FOR STEP TWO OF THE <br />LABORATORY RENOVATION AND ENLARGEMENT. <br />This ordinance had first reading. Councilman Nemeth made a motion to set the ordinance for publ <br />hearing and second reading on September 8, 1975, seconded by Councilman Kopczynski. The motion <br />carried. <br />ORDINANCE AN ORDINANCE TRANSFERRING $6,000.00 <br />FROM ACCOUNT Q -11, "SALARIES ", TO ACCOUNT <br />Q -251, "REPAIR OF BUILDINGS AND STRUCTURES ", <br />BOTH ACCOUNTS BEING WITHIN THE FIRE <br />DEPARTMENT BUDGET WITHIN THE GENERAL <br />FUND. <br />This ordinance had first reading. Councilman Miller made a motion to set the ordinance for publi <br />hearing and second reading on August 25, 1975, seconded by Councilman Kopczynski. The motion <br />carried. <br />ORDINANCE AN ORDINANCE APPROPRIATING MONEYS FOR THE <br />PURPOSE OF DEFRAYING THE EXPENSES OF THE <br />SEVERAL DEPARTMENTS OF THE CITY GOVERNMENT <br />OF THE CITY OF SOUTH BEND, INDIANA, FOR THE <br />FISCAL YEAR BEGINNING JANUARY 1, 1976, AND <br />ENDING DECEMBER 31, 1976, INCLUDING ALL <br />OUTSTANDING CLAIMS AND OBLIGATIONS, AND <br />FIXING A TIME WHEN THE SAME SHALL TAKE <br />EFFECT. <br />This ordinance had first reading. Councilman Kopczynski made a motion to set the ordinance for <br />public hearing and second reading on August 25, 1975, seconded by Councilman Nemeth. The motion <br />carried. <br />
