I <br />REGULAR MEETING NOVEMBER 9, 1981 <br />Council Member Dombrowski made a motion to resolve into the Committee of the Whole, <br />seconded by Council Member Taylor. The motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the Committee <br />of the Whole on Monday, November 9, at 7:16 p.m., with nine members present. Chair- <br />man Voorde presiding. <br />BILL NO. 86 -81 <br />A BILL AMENDING ORDINANCE NO. 4990 -68, AS <br />AMENDED, COMMONLY KNOWN AS THE ZONING ORDI'N.ANGE <br />OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER <br />21, MUNICIPAL CODE) (807 E. JEFFERSON.) <br />Now is the time heretofore set for public hearing on the above bill, <br />proponents and opponents were given an opportunity to be heard. David <br />Behr, of Area Plan, indicated this petition originally was to rezone <br />to "C" Commercial two parcels of property, one on Jefferson and one with frontage on <br />Washington and St. Peter. He indicated that that the Commission recommended that the <br />petition be amended to include only the property on Jefferson. He indicated that the <br />petition has now been amended and the Commission is giving it a favorable recommendation, <br />subject to a final site plan. Council President McGann made a motion to accept the <br />amended bill and petition filed in the City Clerk's office, seconded by Council Member <br />Taylor. The motion carried. Richard Morgan, attorney representing Anchor Realty, <br />made the presentation for the bill. He indicated this bill seeks to rezone the Anchor <br />property from "B" to "C" which will allow teachers Credit Union to expand. He indicated <br />there would be no changes made to their present building on the property. Isadore <br />Rosenfeld, attorney for Teacher's Credit Union, indicated that their ultimate plans <br />are to rezone this property for an additional building. Council Member Szymkowiak <br />made a motion to recommend this bill to the Council favorable, seconded by Council <br />Member Taylor. The motion carried. <br />BILL NO. 122 -81 A BILL TO VACATE SUNNYMEDE AVENUE FROM THE EAST RIGHT -OF -WAY <br />LINE OF 35TH STREET EAST, FOR A DISTANCE OF 114' (ONE HUNDRED <br />FOURTEEN FEET), ALL BEING IN FERNWOOD ADDITION TO CITY OF <br />SOUTH BEND, 5T. JOSEPH COUNTY, INDIANA. <br />Now is the time heretofore set for public hearing on the above bill,...proponents and <br />opponents were given an opportunity to be heard. Stephen Drendall, 3503 Sunnymede, <br />made the presentation for the vacation. He indicated that the abutting property was <br />recently purchased by Holy Cross Health Systems, and he had contacted them regarding <br />this vacation, however, they did not express an opinion for or against the petition. <br />John Leszczynski, Director of Public Works, indicated that the Board of Works recommended <br />unfavorable on this petition, however, if Holy Cross Health Systems agrees to the <br />vacation of the entire street, they would change their recommendation to favorable. <br />Council Member Taylor made a motion to continue this bill until the November 23, <br />meeting of the Council, seconded by Council Member Serge. The motion carried. <br />BILL NO. 123 -81 <br />A BILL TO VACATE THE FIRST NORTH -SOUTH ALLEY <br />WEST OF OLIVE STREET RUNNING SOUTH FROM THE <br />NORTH LINE OF LOT 16, EXTENDED EAST TO THE <br />NORTH LINE OF LOT 16, EXTENDED EAST TO THE NORTH LINE OF LOT <br />15 (WHICH ALSO IS THE SOUTH RIGHT -OF -WAY LINE OF DUBAIL <br />STREET) FOR A DISTANCE OF 320' (THREE HUNDRED TWENTY FEET), <br />ALL BEING IN OLIVER PLACE ADDITION TO THE CITY OF SOUTH <br />BEND, ST. JOSEPH COUNTY, IN. <br />Now is the time heretofore set for public hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. Gordon Lord, attorney representing <br />the petitioner, made the presentation for the bill. He indicated that the petitioner <br />owned the real estate on both sides of the alley. He indicated that immediately to <br />the west of the alley is Wabash Street, and one -half of Wabash was vacated years ago, <br />and to the north is Dubail Street wich is undeveloped. He indicated that 320' to the <br />south is not used as a public alley. He indicated they would be willing to amend the <br />petition to provide access to either Olive or Wabash. John`Les`zczysnki, Director of <br />Public works, indicated that the Board of Works had recommended this vacation unfavorable <br />however, if they were willing to amend the petition, the Board would reconsider the <br />petition. Council Member Taylor made a motion to continue this bill, and refer this <br />matter back to the Board of Works, seconded by Council Member Crone. The motion <br />carried. <br />BILL NO. 124 -81 <br />A BILL TO VACATE THE FIRST EAST -WEST ALLEY SOUTH OF DUNHAM <br />STREET RUNNING FROM WALNUT STREET TO HARRIS STREET FOR A <br />DISTANCE OF 148.5 FT. BEING IN ARNOLD'S SUB OF PART OF <br />B.O.L. 101 IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, IN. <br />Now is the time heretofore set for public hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. Mark DeWolf, 809 S. Walnut, made <br />the presentation for the bill. He indicated the alley is not used for a garage access <br />or access to any lot. He indicated for reasons for theft and danger to his children, <br />he wanted this alley vacated. John Leszczynski, Director of Public Works, indicated <br />that the Board of Works gave a favorable recommendation on this vacation. Ed Zajac,.. <br />815 S. Walnut, spoke in favor of this vacation. Council Member Taylor made a motion <br />to recommend this bill to the Council favorable, seconded by Council Member Dombrowski. <br />The motion carried. <br />
