REGULAR MEETING JULY 13, 1981 ORDINANCE NO. 6938 -81 AN ORDINANCE AMENDING CHAPTER 20 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, BY THE INCLUSION OF NEW ARTICLE 12 ENTITLED MOTOR VEHICLE NOISE CONTROL. This bill had second reading. Council Member Taylor made a motion to amend this bill, as amended in the Committee of the Whole, seconded by Council Member Beck. The motion carried. Council Member Taylor made a motion to pass this bill, as amended, seconded by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 6939 -81 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 1, SECTION 2 -2 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, ENTITLED ADOP- TION OF RULES AND REGULATIONS OF THE COMMON COUNCIL AND POWERS THERETO. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Taylor. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 6940 -81 AN ORDINANCE APPROPRIATING $500,000.00 FROM THE CUMULATIVE SEWER BUILDING AND SINKING FUND TO PROJECT CS 811, OLD CLEVELAND ROAD SANITARY SEWER, WITHIN THE CUMULATIVE SEWER BUILDING AND SINKING FUND. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Voorde. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 6941 -81 AN ORDINANCE OF THE CITY OF SOUTH BEND SETTING FEES CHARGED BY THE SOUTH BEND POLICE DEPARTMENT FOR CERTAIN SERVICES. This bill had second reading. ORDINANCE NO. 6942 -81 AN ORDINANCE APPROPRIATING $285,000 FROM THE WATER WORKS GENERAL FUND FOR CONTRACTUAL SERVICES BY CONVERSE /TEN -ECH AND APPROVING THE AWARD OF CONTRACTS AND EXPENDITURES FOR SERVICES BY CONVERSE TEN -ECH. RESOLTUIONS RESOLUTION A RESOLUTION OF THE SOUTH BEND COMMON COUNCIL DESIGNATING AND ESTABLISHING AN HISTORICALLY SIGNIFICANT BUILDING BY RESOLUTION AS REQUESTED. Council Member Beck made a motion to continue this resolution indefinitely, seconded by Council Member Taylor. The motion carried. RESOLUTION NO. 891 -81 AN INDUCEMENT RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA, RELATING TO: X -RAY EQUIPMENT, INC. PROJECT. WHEREAS, at the present time there are insufficient employment opportunities and insufficient diversification of business, commerce and industry in and near the City of South Bend, Indiana (the "City "); and WHEREAS, the economic welfare of the city would be benefited by the acquisition of economic development facilities in the City pursuant to the provisions of Indiana Code 18 -6 -4.5 (the "Act "); and WHEREAS, X -Ray Equipment, Inc., an Indiana corporation ( "X -Ray Equipment ") pro- poses to acquire economic development facilities to be located in the City as defined in the Act if the City will finance costs of such economic development facilities pursuant to the Act; and WHEREAS, the South Bend Economic Development Commission has received an ap- plication by X -Ray Equipment for the issuance of City of South Bend Economic Develop- ment Bonds in an amount not to exceed Eight Hundred Thousand and no /100 Dollars ($800,000.01 repayable over an eight (8) year period with interest thereon at a rate consistent with interest rates generally paid on tax - excempt bonds at the time the bonds are issued in order to purchase equipment to be leased to Radiology, Inc., an Indiana professional corporation, resulting in an increase of approximately seven (7) additional employees by the principal user with an increased annual payroll of approximately One Hundred Thousand and no /100 Dollars ($100,000.00) per year. NOW, THEREFORE, the Common Council of the City of South Bend, Indiana resolves as follows:
