REGULAR MEETING JULY 13, 1981 <br />ORDINANCE NO. 6938 -81 <br />AN ORDINANCE AMENDING CHAPTER 20 OF THE MUNICIPAL CODE OF <br />THE CITY OF SOUTH BEND, INDIANA, BY THE INCLUSION OF NEW <br />ARTICLE 12 ENTITLED MOTOR VEHICLE NOISE CONTROL. <br />This bill had second reading. Council Member Taylor made a motion to amend this bill, <br />as amended in the Committee of the Whole, seconded by Council Member Beck. The motion <br />carried. Council Member Taylor made a motion to pass this bill, as amended, seconded <br />by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes. <br />ORDINANCE NO. 6939 -81 <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING CHAPTER 2, ARTICLE 1, SECTION 2 -2 OF <br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, ENTITLED ADOP- <br />TION OF RULES AND REGULATIONS OF THE COMMON COUNCIL AND <br />POWERS THERETO. <br />This bill had second reading. Council Member Serge made a motion to pass this bill, <br />seconded by Council Member Taylor. The bill passed by a roll call vote of nine ayes. <br />ORDINANCE NO. 6940 -81 AN ORDINANCE APPROPRIATING $500,000.00 FROM THE CUMULATIVE <br />SEWER BUILDING AND SINKING FUND TO PROJECT CS 811, OLD <br />CLEVELAND ROAD SANITARY SEWER, WITHIN THE CUMULATIVE SEWER <br />BUILDING AND SINKING FUND. <br />This bill had second reading. Council Member Serge made a motion to pass this bill, <br />seconded by Council Member Voorde. The bill passed by a roll call vote of nine ayes. <br />ORDINANCE NO. 6941 -81 AN ORDINANCE OF THE CITY OF SOUTH BEND SETTING FEES CHARGED <br />BY THE SOUTH BEND POLICE DEPARTMENT FOR CERTAIN SERVICES. <br />This bill had second reading. Council Member Taylor made a motion to amend this bill, <br />as amended in the Committee of the Whole, seconded by Council Member Dombrowski. The <br />motion carried. The bill passed by a roll call vote of nine <br />ayes. <br />ORDINANCE NO. 6942 -81 <br />AN ORDINANCE APPROPRIATING $285,000 FROM THE WATER WORKS <br />GENERAL FUND FOR CONTRACTUAL SERVICES BY CONVERSE /TEN -ECH <br />AND APPROVING THE AWARD OF CONTRACTS AND EXPENDITURES FOR <br />SERVICES BY CONVERSE TEN -ECH. <br />This bill had second reading. Council Member Beck made a motion to amend the bill, as <br />amended in the Committee of the Whole, seconded by Council Member Dombrowski. The <br />motion carried. Council Member Beck made a motion to pass the bill, as amended, <br />seconded by Council Member Dombrowski. The bill passed by a roll call vote of nine <br />ayes. <br />RESOLTUIONS <br />RESOLUTION <br />A RESOLUTION OF THE SOUTH BEND COMMON COUNCIL DESIGNATING <br />AND ESTABLISHING AN HISTORICALLY SIGNIFICANT BUILDING BY <br />RESOLUTION AS REQUESTED. <br />Council Member Beck made a motion to continue this resolution indefinitely, seconded <br />by Council Member Taylor. The motion carried. <br />RESOLUTION NO. 891 -81 AN INDUCEMENT RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA, <br />RELATING TO: X -RAY EQUIPMENT, INC. PROJECT. <br />WHEREAS, at the present time there are insufficient employment opportunities and <br />insufficient diversification of business, commerce and industry in and near the City <br />of South Bend, Indiana (the "City "); and <br />WHEREAS, the economic welfare of the city would be benefited by the acquisition <br />of economic development facilities in the City pursuant to the provisions of Indiana <br />Code 18 -6 -4.5 (the "Act "); and <br />WHEREAS, X -Ray Equipment, Inc., an Indiana corporation ( "X -Ray Equipment ") pro- <br />poses to acquire economic development facilities to be located in the City as defined <br />in the Act if the City will finance costs of such economic development facilities <br />pursuant to the Act; and <br />WHEREAS, the South Bend Economic Development Commission has received an ap- <br />plication by X -Ray Equipment for the issuance of City of South Bend Economic Develop- <br />ment Bonds in an amount not to exceed Eight Hundred Thousand and no /100 Dollars ($800,000.01 <br />repayable over an eight (8) year period with interest thereon at a rate consistent <br />with interest rates generally paid on tax - excempt bonds at the time the bonds are <br />issued in order to purchase equipment to be leased to Radiology, Inc., an Indiana <br />professional corporation, resulting in an increase of approximately seven (7) additional <br />employees by the principal user with an increased annual payroll of approximately One <br />Hundred Thousand and no /100 Dollars ($100,000.00) per year. <br />NOW, THEREFORE, the Common Council of the City of South Bend, Indiana resolves <br />as follows: <br />
