That the Common Council directs the City Clerk, upon receipt of the <br />report of the Area Plan Commission to cause notice of the adoption of this resolution <br />to be published, said publication providing notice of the public hearing before the <br />Common Council on said declaration. <br />SECTION IV. This resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />/s /Lewis A. Mr. Fred Boynton, attorney <br />representing Claeys, indicated that the Council had passed an Economic Development Revenue <br />Bond for this expansion, and now they were requesting tax abatement. He indicated this <br />abatement had been approved by the Council's Economic Development Committee. Council <br />Member Szymkowiak made a motion to adopt this resolution, seconded by Council Member Taylor.!, <br />The resolution was adopted by a roll call vote of eight ayes and one nay (Council Member <br />Crone.) <br />BILLS, FIRST READING <br />BILL NO. 2 -81 <br />A BILL AUTHORIZING THE CITY OF SOUTH BEND TO ISSUE ITS "CITY OF <br />SOUTH BEND ECONOMIC DEVELOPMENT REVENUE NOT SERIES 1981 (SOUTH <br />BEND MEDICAL FOUNDATION, INC. PROJECT)" AND APPROVING OTHER <br />ACTIONS IN RESPECT THERETO. <br />This bill had first .reading. Council Member Serge made a motion to set this bill for public; <br />hearing and second reading January 26, 1981, seconded by Council Member Taylor. The motion { <br />carried. <br />BILL NO. 3 -81 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY <br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, <br />INDIANA (CHAPTER 21, MUNICIPAL CODE) (PLAYLAND PARK.) <br />This bill had first reading. Council Member Taylor made a motion to refer this bill to <br />Area Plan, seconded by Council Member Dombrowski. The motion carried. <br />BILL NO. 4 -81 A BILL AMENDING CHAPTER VI OF THE MUNICIPAL CODE OF SOUTH <br />BEND TO BRING THE CODE INTO CONFORMANCE WITH THE UNSAFE <br />BUILDING AW OF THE STATE OF INDIANA, INDIANA CODE 18 -5 -5 =4 <br />(5) (b) AND REPEALING CHAPTER 11, ARTICLE 4, OF THE MUNICIPAL <br />CODE. <br />This bill had first reading. Council Member Taylor made a motion to set this bill for <br />public hearing and second reading January 26, and refer it to the Public Safety Committee, <br />seconded by Council Member Beck. The motion carried. <br />BILL NO. 5 -81 <br />A BILL APPROPRIATING $5,217.00 FROM THE LOCAL EMPLOYMENT <br />OPPORTUNITY FUND TO BE ADMINISTERED BY THE CITY OF SOUTH <br />BEND THROUGH ITS HUMAN RIGHTS COMMISSION AND DEPARTMENT <br />OF HUMAN RESOURCES AND ECONOMIC DEVELOPMENT. <br />This bill had first reading. Council Member Beck made a motion to set this bill for public <br />hearing and second reading January 26, seconded by Council Member Taylor. The motion <br />carried. <br />PRIVILEGE OF THE FLOOR <br />Jane Swan, 1706 Walnut, indicated that the bond issue was a way of home rule, because the <br />taxpayer can overrule the issue. She indicated that if the Park bond had gone as proposed, <br />it would have been defeated. <br />UNFINISHED BUSINESS <br />BILL NO. 132 -80 - 4325 S. Main - Report From Area Plan <br />"Upon a motion by Joseph Simeri, being seconded by Dwight Miller and carred, the <br />proposed ordinance and site development plan of Elmer C. Lucas to zone from "A" <br />Residential, "A" Height and Area to "C" Commercial, "A" Height and Area, properly <br />located at 4325 South Main Street is sent to the Common Council with no recommendation." <br />Council Member Beck made a motion to set this bill for public hearing and second reading <br />January 26, 1981, seconded by Council Member Dombrowski. The motion carried. <br />BILL NO. 136 -80 - Off - Street Parking, Change in Use - Report from Area Plan <br />"Upon a motion by Paul Klein, being seconded by Joseph Simeri and carried, the ordinance <br />initiated by Councilman Lewis A. McGann amending Chapter 21, Section 21 -88 of the Municipal <br />Code of South Bend, modifying the off - street parking and loading facilities, for a change <br />in use is sent to the Common Council with a favorable recommendation." <br />Council Member Taylor made a motion to set this bill for public hearing and second reading <br />January 26, seconded by Council Member Dombrowski.
