(11) "Mobile structure" has the meaning ascribed thereto in IC 22-12-1-17. <br /> (12) "Person" has the meaning ascribed thereto in IC 22-12-1-18. <br /> (13) "Structure" means both Class 1 and Class 2 structures, unless specifically stated <br /> otherwise. <br /> (14) "Temporary structure" has the meaning set forth in 675 IAC 12-6-2 (f). <br /> (15) "Vehicular bridge' has the meaning ascribed thereto in IC 22-12-1-26. <br /> "Terms not defined": Where terms are not defined in this Ordinance and are defined in the <br /> General Administrative Rules, Indiana Building Code, Indiana Fire Code. Indiana <br /> Mechanical Code and Indiana Fuel Gas Code, such terms shall have the meanings <br /> ascribed to them as in those codes. Where terms are not defined through the methods <br /> authorized, such terms shall have ordinarily accepted meanings such as the context <br /> implies. <br /> (Ord. No. 8243-92, § 1) <br /> Nothing contained in this chapter shall be deemed to reduce, limit, or remove any of <br /> the power or authority of the County Health Department,the Health Officer or the Chief of <br /> the Fire Department. <br /> (Ord. No. 8243-92, § 1) <br /> Nothing contained in this chapter shall be deemed to reduce or remove any pertinent <br /> provisions of other ordinances or laws now in effect unless specifically designated in this <br /> chapter or unless such provisions are less restricted than similar provisions of this chapter. <br /> (Ord. No. 8243-92, § I) <br /> (a) No person shall build or construct any new building or structure, or alter, repair, remodel, <br /> demolish, or move an existing structure, or install a sign, billboard, fence, in-ground pool, <br /> or wood burning stove within the City without obtaining, in advance, a permit from the <br /> Department. <br /> (b) Withhold issuance of permits. <br /> (1) Whenever a person owes fees to the Building Department(including checks returned <br /> for insufficient funds, permit fees owed pursuant to the South Bend Municipal Code, or <br /> inspection fees owed pursuant to the South Bend Municipal Code) applies for or <br /> otherwise seeks to obtain a building permit, the Building Commissioner shall withhold <br /> the issuance of a building permit to such person until such time that all fees are paid or <br /> are no longer due and owing by operation of law. <br /> (2) Whenever a person applies for a building permit for a structure that is not being used <br /> or constructed in conformance with the Zoning Ordinance or any other ordinance <br /> relating to land use, the Building Commissioner shall withhold the issuance of the <br /> requested building permit until such time that the structure is brought into conformance <br /> with all applicable ordinances; provided, however, that if additional construction is <br /> Page 3 of 42 <br />
