and if they cannot agree, shad choose a third person, and the appraise- <br />ment of any two shall be binding, after which appraisement, the said <br />i <br />commissioner shall convey said property appraised, to the State Bank of <br />l <br />, Indiana, for the use of her 12th Branch for a price equivalent to 2/3 of <br />said appraisement, which conveyance shall be received in full discharge <br />of so much of the debt secured by the luortgage as amounts to 2/3 of said <br />bappraisement. <br />It is therefore ordered, adjudged rind decreed by the Court, <br />treat there is daze to said Mate Bank of, Indiana., for the use of her <br />12th Branch, yp35, 600 and that all right and equity of recieraption of <br />said defendants or either of them, in and to said rnortgaged premises, <br />excepting lands not herein considered, be and the same is hereby for- <br />e7er foreclosed. Commissioner appointed to snake sale as above agreed <br />-anon, and that complainant recover his costs. <br />On August 16th, 1843, Anthony Defrees, rresident of the said <br />12th Branch of the State Bank of Indiana, files his petition, stating <br />that <br />in pursuance <br />of the provisions of the above <br />decree, -peti.tioner <br />within 3 days from <br />the date of the above decree, <br />chose Ricketson B-ar- <br />roughs <br />to appraise <br />the real estate mentioned and <br />referred to in said <br />decree <br />and that John D. Defrees chose Lot Day as <br />the other appraiser, <br />and on <br />April 25th, <br />1843, said Burroughs and Day, <br />being unable to agree <br />chose John <br />Newell as <br />a third appraiser. That said <br />appraisers being <br />unable to complete the appraiserent within the time limited, said <br />Alexis Coqu.illard and John D. Defrees entered into an agreement for an <br />extension of time, to the 29th of April, 1843, and on April 28th, 1843, <br />said Lot Day and John Newell t the said qieketson Burroughs dissenting <br />thereFromi maale a rc:tuz-n of said appraisement to George iV.
