He indicated that the City of South Bend's fiscal position is <br />in better condition that it has been for the last ten years, therefore, the <br />residents should not perceive our support of the resolution as begging for money. <br />He indicated it was important this resolution be adopted because there are other <br />units of government that need the money. Council Member Taylor made a motion to <br />adopt this resolution, seconded by Council member Barcome. The resolution was <br />adopted by a roll call vote of nine ayes. <br />REPORTS <br />Council Member Voorde indicated that the Zoning and Vacation Committee had met on <br />Bill Nos. 17, 21, 24 and 25 -87 and recommended them to the Council favorably. <br />Council Member Puzzello indicated that the Personnel and Finance and Public Safety <br />Committees had met in a joint session on Bill Nos. 29 and 30 -87 and recommended them <br />to the Council favorably. <br />Council Member Braboy indicated that the Human Resources Committee had met on <br />Resolution Nos. 87 -38, 42, 44, and 45, and recommended them to the Council <br />favorably. <br />Council Member Taylor made a motion to resolve into the Committee of the Whole, <br />seconded by Council Member Voorde. The motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the <br />Committee of the Whole on May 11, at 7:38 p.m., with nine members present. Chairman <br />Puzzello presiding. <br />BILL NO. 17 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 4100 <br />BLOCK SOUTH MAIN STREET IN THE CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Voorde made a <br />motion to accept the substitute bill on file with the City Clerk, seconded by <br />Council Member Zakrzewski. The motion carried. Mike Danch, a representative of Area <br />Plan, gave the staff report, which was favorable. Betty Mangus, 1414 Huffman Drive, <br />indicated the Republican Party planned to build a new headquarters. She indicated <br />this property was previously rezoned, but because of lack of funds they were unable <br />to start the project. She indicated they now have the funds and were requesting the <br />rezoning. Council Member Taylor made a motion to recommend this bill to the Council <br />favorably, as amended, seconded by Council Member Serge. The motion carried. <br />BILL NO. 21 -87 A BILL AMENDING CHAPTER 21 OF THE MUNICIPAL CODE OF THE CITY OF <br />SOUTH BEND REGARDING EXCEPTIONS IN "C" COMMERCIAL DISTRICTS. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Voorde made a <br />motion to accept the substitute bill on file with the City Clerk, seconded by <br />Council Member Zakrzewski. The motion carried. Mike Danch, a representative of <br />Area Plan gave the staff report, which was favorable. Ann Kolata, Deputy Director <br />of Redevelopment, made the presentation for the bill. She indicated that currently <br />there are many older commercial buildings that have a business on the first floor <br />and apartments above. She indicated that many of the buildings are grandfather in, <br />however, if these apartments are not occupied for more than one year the residential <br />use is no longer permitted as there is no current category that allows for a <br />commercial /residential use in a single building. She indicated this bill would <br />allow residential use in a building zoned "C" if it met all of the requirements and <br />the exception was approved by the Board of Zoning Appeals. Council Member Serge <br />made a motion to recommend this bill to the Council favorably, seconded by Council <br />_ Member Braboy. The motion carried. <br />BILL NO. 24 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: ALL OF HIGH <br />STREET LYING SOUTH OF THE SOUTH LINE OF HAWBAKER STREET, ALSO, <br />ALL OF BOWEN STREET LYING WEST OF A POINT 480 FEET WEST OF THE <br />WEST LINE OF MIAMI STREET. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Richard Morgan, Attorney for <br />the petitioners, made the presentation for the bill. He indicated they were <br />requesting this vacation in order to build a shopping center complex. Council <br />Member Taylor made a motion to recommend this bill to the Council favorably, <br />seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 25 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST <br />EAST -WEST ALLEY SOUTH OF MISHAWAKA AVENUE, RUNNING EAST FROM 20TH <br />STREET FOR A DISTANCE OF APPROXIMATELY 127.5 FEET IN SHANK'S 1ST <br />ADDITION TO THE CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Attorney, Kathleen <br />Cekanski - Farrand indicated the bill should be amended in Section IV, as follows: <br />Said vacation shall be subject to the conditions of the Board of Public Works <br />established at its April 14, 1987 meeting, namely: (1) An easement for ingress and <br />
