benefits that can be reasonably expected to result from the proposed <br />described redevelopment or rehabilitation; and <br />F. That the Totality of benefits is sufficient to justify the requested <br />deduction, all of which satisfy the requirements of Indiana Code 6- 1.1 -12.1- <br />3. <br />G. That the area is located in an Economic Development Target Area <br />designated as such under Indiana Code 6 -1.1- 12.1 -7. <br />SECTION III. The Common Council hereby determines and finds that the proposed <br />described redevelopment or rehabilitation can be reasonably expected to yield <br />benefits identified in the Statement of Benefits set forth as Sections I through <br />II of the Petition for Real Property Tax Abatement Consideration and that the <br />Statement of Benefits form prescribed by the State Board of Accounts are sufficient <br />to justify the deduction granted under Indiana Code 6 -1.1- 12.1 -3. <br />SECTION IV. The Common Council hereby accepts the report and recommendation of the <br />Human Resources and Economic Development Committee that the area herein described <br />be designated an Economic Revitalization Area and hereby adopts a Resolution <br />designating this area as an Economic Revitalization Area for purposes of real <br />property tax abatement. <br />SECTION V. The designation as an Economic Revitalization Area shall be limited <br />to two (2) calendar years from the date of the adoption of this Resolution by the <br />Common Council. <br />SECTION VI. The Common Council hereby determines that the property owner is <br />qualified for and is granted property tax deduction for a period of three (3 -3) <br />years. <br />SECTION VII. The Common Council directs the City Clerk to cause notice of the <br />adoption of this Declaratory Resolution for Real Property Tax Abatement to be <br />published pursuant to Indiana Code 5 -3 -1 and Indiana Code 6 -1.1- 12.1 -2.5, said <br />publication providing notice of the public hearing before the Common Council on the <br />proposed confirming of said declaration. <br />SECTION VIII. This Resolution shall be in full force and effect from and after its <br />adoption by the Common Council and approval by the Mayor. <br />/s/ Ann Puzzello <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Council Member Kelly <br />reported that the Community and Economic Development Committee had met on this <br />resolution and recommended it to the Council favorable. Rick Ferrara, the <br />petitioner, made the presentation for the resolution. He indicated he operated <br />Craig's Western and Mayflower Service Center, which includes a convenience store <br />and car wash. He indicated they planned to add three additional service bays and <br />to relocate the war wash to the front of the station at a cost of approximately <br />$145,000. Council Member Zakrzewski made a motion to adopt this resolution, <br />seconded by Council Member Ladewski. The resolution was adopted by a roll call <br />vote of nine ayes. <br />RESOLUTION NO. 2153 -94 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA APPROVING AN AGREEMENT RE- ESTABLISHING THE <br />ST. JOSEPH COUNTY HOUSING CONSORTIUM AND AUTHORIZING THE <br />EXECUTION THEREOF <br />WHEREAS, on November 28, 1990, the National Affordable Housing Act (NAHA) of <br />1990, also known as the Cranston - Gonzales Act, became law, to implement its stated <br />goal that every American family be able to afford a decent home; and <br />WHEREAS, NAHA requires any governmental unit to formulate and submit <br />appropriate plans in order to be eligible to receive funds from several existing <br />federal programs, including Community Development Block Grants (CDBG), the Home <br />Investment Partnership Program (HOME), Emergency Shelter Grants (ESG), as well as <br />to be eligible to receive funds from new housing assistance programs created by <br />NAHA; and <br />WHEREAS, NAHA provides for the designation of geographically contiguous units <br />of general local government to participate as consortia in, and thereby be <br />considered a single unit of general local government for purposes of HOME; and <br />WHEREAS, I.C. 36 -1 -7, the Interlocal Cooperation Act, authorizes one or more <br />governmental entities to exercise, jointly or by one entity on behalf of the <br />others, powers that may be exercised by such units severally; and <br />WHEREAS, pursuant to the Interlocal Cooperation Act, the Cities of South Bend <br />and Mishawaka, and the County of St. Joseph, being contiguous units of general <br />local government have formed the St. Joseph Housing Consortium, which, by agreement <br />of the member entities, is to terminate on December 31, 1994; and <br />WHEREAS, the Cities of South Bend, Mishawaka, and St. Joseph County are <br />
