REGULAR MEETING DECEMBER 23, 1996 Section III. Kernan, Mayor A hearing was held on the resolution at this time. Council President Luecke read the resolution. Richard Nussbaum, City Attorney and Jeff Rinard, Deputy City Controller, spoke in favor of this resolution. Council Member Coleman made a motion to adopt the resolution by acclamation, seconded by Council Member Pfeifer. The motion carried. Council Member Coleman made a motion to resolve into the Committee of the Whole, seconded by Council Member Luecke. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole at 8:23 p.m. with nine members present. Chairman pro tem Coleman presiding. BILL NO. 80 -96 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1615 PORTAGE AVENUE, IN THE CITY OF SOUTH BEND, INDIANA This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Zakrzewski reported that the Zoning and Vacation Committee had met on this bill and recommended it to the Council unfavorable. John Byorni, Area Plan, reported that the petitioners were requesting rezoning for this property in order to allow for a video store. Rick Morgan, attorney for Northwest Bank, indicated this building has been vacant for two years and the bank feels this particular use, a video store, is less intensive than some of the other uses in "C" Commercial. Tim Reynold, regional manager for Family Video, indicated Family Video owns their stores, they take care of the property and have never closed a store. Mike Sculati, 1414 Woodlawn, Charlie Maternowski, 716 Beale; Bill Borders, 946 Roosevelt; Elaine Able, 5102 Kinyon; and Timothy Rosh, 1758 N. Olive, spoke against this rezoning. Council Member Varner made a motion to recommend this bill to the Council unfavorable, seconded by Council Member Zakrzewski. The motion carried. Council Member Varner made a motion to recess, seconded by Council Member Zakrzewski. The motion carried and the meeting was recessed at 9:20 and reconvened at 9:25 p.m.
