Kernan, Mayor <br />A hearing was held on the resolution at this time. Council <br />President Luecke read the resolution. Richard Nussbaum, City <br />Attorney and Jeff Rinard, Deputy City Controller, spoke in favor <br />of this resolution. Council Member Coleman made a motion to <br />adopt the resolution by acclamation, seconded by Council Member <br />Pfeifer. The motion carried. <br />Council Member Coleman made a motion to resolve into the <br />Committee of the Whole, seconded by Council Member Luecke. The <br />motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South <br />Bend met in the Committee of the Whole at 8:23 p.m. with nine <br />members present. Chairman pro tem Coleman presiding. <br />BILL NO. 80 -96 A BILL AMENDING THE ZONING ORDINANCE FOR <br />PROPERTY LOCATED AT 1615 PORTAGE AVENUE, IN <br />THE CITY OF SOUTH BEND, INDIANA <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Zakrzewski reported that the Zoning and <br />Vacation Committee had met on this bill and recommended it to the <br />Council unfavorable. John Byorni, Area Plan, reported that the <br />petitioners were requesting rezoning for this property in order <br />to allow for a video store. Rick Morgan, attorney for Northwest <br />Bank, indicated this building has been vacant for two years and <br />the bank feels this particular use, a video store, is less <br />intensive than some of the other uses in "C" Commercial. Tim <br />Reynold, regional manager for Family Video, indicated Family <br />Video owns their stores, they take care of the property and have <br />never closed a store. Mike Sculati, 1414 Woodlawn, Charlie <br />Maternowski, 716 Beale; Bill Borders, 946 Roosevelt; Elaine Able, <br />5102 Kinyon; and Timothy Rosh, 1758 N. Olive, spoke against this <br />rezoning. Council Member Varner made a motion to recommend this <br />bill to the Council unfavorable, seconded by Council Member <br />Zakrzewski. The motion carried. <br />Council Member Varner made a motion to recess, seconded by <br />Council Member Zakrzewski. The motion carried and the meeting <br />was recessed at 9:20 and reconvened at 9:25 p.m. <br />
