REGULAR MEETING AUGUST 23, 1999 <br />Council President Coleman stated that the Easement Agreements must be signed off by both parties. <br />The only way this vacation would not take effect is if the Easement Agreements are not signed by <br />both parties. <br />There being no one else present wishing to address the Council concerning this matter, <br />- Councilmember Kelly made a motion to send this bill, as amended, to the full Council favorably. <br />Council President Coleman seconded the motion which carried by a voice vote of eight (8) ayes. <br />BILL NO. 60 -99 A BILL TO VACATE THE FOLLOWING DESCRIBED <br />PROPERTY: FIRST EAST/WEST ALLEY NORTH OF <br />LINCOLNWAY WEST FROM THE WEST RIGHT -OF- <br />WAY OF CUSHING STREET TO THE EAST RIGHT -OF- <br />WAY OF THE FIRST NORTH/SOUTH ALLEY WEST OF <br />CUSHING STREET FOR A DISTANCE OF 128 FEET <br />AND A WIDTH OF 10 FEET. PART LOCATED IN <br />CUSHING AND LINDSEY'S SUB., CITY OF SOUTH <br />BEND, ST. JOSEPH COUNTY, INDIANA <br />Councilmember Varner reported that the Public Works and Property Vacation Committee met on <br />this bill and sends it to the Council with a favorable recommendation. <br />Ms. Dea Andrews, Administration Manager, South Bend Heritage Foundation, 914 Lincolnway <br />West, South Bend, Indiana, on behalf of Jeff Gibney, Executive Director, South Bend Heritage <br />Foundation, Petitioner, made the presentation for this bill. <br />Ms. Andrews stated that South Bend Heritage has acquired four (4) parcels of property one of which <br />is the Blume's block which they are in the process of making into the Heritage Community <br />Development Center. The alley which is behind this parcel is the alley in question. They own the <br />lot behind that and want to make parking there. Ms. Andrews noted that they want control over the <br />maintenance and improvements. They will change the ingress and egress without barriers and traffic <br />will still be able to go through from Cushing to the north/south alley to the West of that alley. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to this <br />bill, Councilmember Varner made a motion for favorable recommendation to full Council <br />concerning this bill. Council President Coleman seconded the motion which carved by a voice vote <br />of eight (8) ayes. <br />BILL NO. 43-99 A BILL AMENDING THE ZONING ORDINANCE FOR <br />PROPERTY LOCATED AT 1422 E. CALVERT ST. IN <br />THE CITY OF SOUTH BEND, INDIANA <br />Councilmember Varner noted that this bill comes to the Council without a recommendation of the <br />Zoning and Annexation Committee due to the lack of a quorum. <br />Mr. John Byorni, Assistant Director, Area Plan Commission, Room 1140 County -City Building, <br />South Bend, Indiana, presented the report from the Commission. Mr. Byorni advised that the <br />petitioner is requesting a zone change from "C" Commercial, "D" Height and Area to "A" <br />Residential, "A" Height and Area to allow a single family residence. The property currently contains <br />a single family home. Access to the site is from Calvert and Vernon Streets. The total site to be <br />rezoned is four thousand eight hundred (4,800) square feet. Mr. Byorni further stated that based on <br />information available prior to the Area Plan Commission Public Hearing, the staff recommends that <br />this petition be sent to the Council with a favorable recommendation. This rezoning would bring <br />the site into conformance with the current land use and the adjacent residential neighborhood. <br />Further, based on its Public Hearing held on July 20,1999, the Area Plan Commission sends this bill <br />with a favorable recommendation. <br />
