REGULAR MEETING JULY 26, 2004 <br /> Mr. James A. Masters, Attorney at Law,Nemeth &Masters, 215 S. St. Joseph St., Suite <br /> 600, South Bend, Indiana, stated that he is representing the petitioners, Steve and Jean <br /> Cooreman. <br /> Mr. Masters asked the Council to continue this bill until the October 11, 2004 meeting of <br /> the South Bend Common Council. <br /> Councilmember Kuspa made a motion to continue this bill at the request of the petitioner <br /> until the October 11, 2004, meeting of the South Bend Common Council. <br /> Councilmember Varner seconded the motion which carried by a voice vote of nine (9) <br /> ayes. <br /> BILL NO. 40-04 PUBLIC HEARING ON A BILL TO VACATE THE <br /> FOLLOWING DESCRIBED PROPERTY: THE FIRST <br /> STREET TO BE VACATED IS THE SOUTH HALF OF <br /> THE ANGELA BLVD. RIGHT OF WAY FROM NOTRE <br /> DAME AVENUE, EAST FOR A DISTANCE OF 930 <br /> FEET, MORE OR LESS, TO THE WEST RIGHT OF <br /> WAY LINE OF EDDY STREET AND A WIDTH OF 40 <br /> FEET. BECAUSE THE CITY LIMIT LINE GOES <br /> DOWN THE CENTERLINE OF ANGELA BLVD THE <br /> VACATION WILL BE FOR THE SOUTH HALF OF <br /> THE RIGHT OF WAY ONLY. THE SECOND STREET <br /> TO BE VACATED IS THE WEST HALF OF THE EDDY <br /> STREET RIGHT OF WAY FROM ANGELA BLVD. <br /> SOUTH A DISTANCE OF 380 FEET,MORE OR LESS, <br /> TO THE NORTH RIGHT OF WAY LINE OF ANGELA <br /> BLVD. EXTENDED FROM NOTRE DAME AVENUE <br /> AND A WIDTH OF 35 FEET. AGAIN BECAUSE THE <br /> CITY LIMITS LINE GOES DOWN THE CENTERLINE <br /> OF EDDY STREET, THE VACATION WILL BE FOR <br /> THE WEST HALF OF THE RIGHT OF WAY ONLY <br /> Councilmember Varner, Chairperson, Public Works and Property Vacation Committee <br /> reported that this committee met on this bill this afternoon and voted to send it to the full <br /> Council with a favorable recommendation. <br /> Mr. Bruce Bancroft, Attorney At Law, Barnes &Thornburg, 100 N. Michigan Street, 6th <br /> Floor, South Bend, Indiana, advised that he is representing the petitioner,University of <br /> Notre Dame, made the presentation for this bill. <br /> Mr. Bancroft stated that the petitioner plans to vacate the streets in order to facilitate the <br /> development of their campus plan. The vacation would allow the elimination of the 5- <br /> curve between Notre Dame Avenue and Eddy Street and to facilitate the re-alignment of <br /> Edison Road and to enhance the possibility of developing improvements along Eddy <br /> Street as potential mixed-use commercial/residential. <br /> This being the time heretofore set for the Public Hearing on the above bill,proponents <br /> and opponents were given an opportunity to be heard. <br /> There being no one present wishing to speak to the Council either in favor of or in <br /> opposition to this bill, Councilmember Puzzello made a motion for favorable <br /> recommendation to full Council concerning this bill.
