As the Chair of the South Bend Common Council Public Work and Property Vacation <br /> Henry Davis, Jr. Committee and as the Councilman, whose district is being affected by this matter, I am writing <br /> Second District this letter to share my sincere concerns regarding the MOA agreement that is being proposed <br /> between the City of South Bend and the two liquidators who bought the New Energy Corp. <br /> Third District Valerie plant, Maynards Industries and Biditup Auctions Worldwide. <br /> Fred Ferlic My concerns are the following: <br /> Fourth District <br /> David Varner 1. There seems to be no past evidence that any one of these companies has had success in <br /> Fifth District securing an operator in any of their past dealings. If they have, please indicate when that <br /> success has occurred in their past practice. <br /> Oliver J. Davis <br /> Sixth District 2. What are the incentives in the MOA for the liquidators to secure an operator for the plant? <br /> Derek D. Dieter <br /> At Large 3. The issue of paying$1000.00 a week for security or else the pumps would be turned off is a <br /> concern that was raised by several Common Council members. Please explain this part of <br /> Gavin Ferlic <br /> At Large the agreement, especially in light that there is not incentive to for the liquidators to proceed <br /> in a faster manner in securing an operator. <br /> Karen L.
