REGULAR MEETING JANUARY 28, 2013 <br /> <br /> <br /> <br /> <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Dieter made a motion for favorable recommendation to full Council <br />concerning this bill. Councilmember Scott seconded the motion which carried by a voice vote of <br />nine (9) ayes. <br /> <br /> <br />BILL NO. 04-13 PUBLIC HEARING ON A BILL TO VACATE <br /> THE FOLLOWING DESCRIBED PROPERTY: <br /> AN IRREGULARLY SHAPED PORTION OF <br /> RIGHT-OF-WAY OF INDIANA AVENUE <br /> LOCATED AT THE NORTHWEST <br /> INTERSECTION OF SAID INDIANA AVENUE <br /> WITH KEMBLE STREET <br /> <br />Councilmember Oliver Davis, Chairperson, Public Works and Property Vacation Committee, <br />reported that this committee met this afternoon and it was the consensus of the committee to send <br />this bill to the full council with a favorable recommendation. <br /> <br />Mr. Michael Danch, President, Danch, Harner and Associates 1643 Commerce Drive, South <br />Bend, Indiana, made the presentation for this bill on behalf of the petitioners the City of South <br />Bend Redevelopment Department and MM Vance LLC. <br /> <br />Mr. Danch advised that his clients are requesting the approval of a partial street vacation for a <br />portion of Indiana Avenue adjacent to 1531 Kemble Street, South Bend, Indiana. This requested <br />vacation would allow for the reconfiguration of the Kemble Street property by adding additional <br />land to the site. It will also allow for a reconfiguration of the dedicated right-of-way for the <br />north side of Indiana Avenue. The intent is to place all existing street improvements into a <br />dedicated right-of-way. Once the Street Vacation is approved, a Subdivision Replat would be <br />approved to create a single larger legal lot of record for the property owner. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Dieter made a motion for favorable recommendation to full Council <br />concerning this bill. Councilmember Scott seconded the motion which carried by a voice vote of <br />nine (9) ayes. <br /> <br /> <br />BILL NO. 05-13 PUBLIC HEARING ON A BILL TO VACATE <br /> THE FOLLOWING DESCRIBED PROPERTY: <br /> THE FIRST NORTH/SOUTH ALLEY WEST OF <br /> MICHIGAN STREET FROM MADISON STREET <br /> NORTH TO THE FIRST EAST/WEST ALLEY <br /> <br /> <br />Councilmember Oliver Davis, Chairperson, Public Works and Property Vacation Committee, <br />reported that this committee met this afternoon and it was the consensus of the committee to send <br />this bill to the full council with a favorable recommendation. <br /> <br />Mr. James Lietzan, DLZ, 2211 E. Jefferson Blvd., South Bend, Indiana, made the presentation <br />for this bill on behalf of the petitioner Beacon Health System. <br /> <br />Mr. Lietzan advised that Beacon Health System is seeking the vacation of the real property to <br />enhance the parking areas for the hospital staff and visitors. He stated that the vacation of these <br />alleys will allow Memorial Hospital to reconstruct and expand their parking facilities. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />5 <br /> <br /> <br />
