REGULAR MEETING JANUARY 14, 2013 Council President Derek Dieter made the presentation for this bill. He advised that this bill is a “housekeeping measure” so that newly renamed Community Investment Department will be overseen by the proposed “Community Investment Committee.” He stated that as you recall that the City Administration recently filed an ordinance changing the department’s name which was passed by the Council on October 22, 2012. He noted that the Council has eleven (11) Standing Committees with each having specified areas of jurisdiction. This bill would formally amend the South Bend Municipal Code so that the names are consistent. This being the time heretofore set for the Public Hearing on the above bill, proponents and opponents were given an opportunity to be heard. There being no one present wishing to speak to the Council either in favor of or in opposition to that bill, Councilmember Gavin Ferlic made a motion for favorable recommendation to full Council concerning this bill. Councilmember Dieter seconded the motion which carried by a voice vote of nine (9) ayes. RISE AND REPORT Councilmember Henry Davis made a motion to rise and report to full Council. White, Chairperson Committee of the Whole REGULAR MEETING RECONVENED Be it remembered that the Common Council of the City of South Bend reconvened in the Council Chambers on the fourth floor of the County-City Building at 8:33 p.m. Council President Derek Dieter, presided with nine (9) members present. BILLS – THIRD READING ORDINANCE NO. 10212-13 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE ARTICLE 2, RESIDENTIAL DISTRICTS, TO ALLOW THE RAISING AND CARE OF CHICKENS AS AN ACCESSORY USE; AND ADDING CERTAIN RELATED DEFINITIONS This bill had third reading. Councilmember White made a motion to amend this bill as in the Committee of the Whole. Councilmember Scott seconded the motion which carried by a voice vote of nine (9) ayes. Additionally, Councilmember White made a motion to pass this bill as amended, and refer back to the Area Plan Commission for further action, in light of the amendments. Councilmember Schey seconded the motion which carried. The bill passed by a roll call vote of six (6) ayes and three (3) nays (Councilmember’s Dr. Fred Ferlic, Dr. David Varner and Oliver Davis.) 9
