3 <br /> 1 Zoning and Annexation Committee <br /> March 10, 2003 <br /> Page 2 <br /> In response to a question from Dr. Varner, Mr. Byorni noted that the property is located behind <br /> Nuner School. <br /> Tiberius Mihalache, the Petitioner, made the presentation. He noted that the condition of the real <br /> property is currently in "bad shape". He stated that he would construct a "high end" multi-family <br /> multi-family residential building. <br /> Dennis Whitacker, the President of the River Park Neighborhood Association, spoke in favor of <br /> the rezoning. He noted that the River Park Neighborhood Association Board voted to endorse the <br /> plan, noting that it is directly across from the Partnership Center. He concluded his remarks by <br /> stating that the development would be a positive improvement for the neighborhood. <br /> Council Member Kelly noted that he is the District Council Member where the proposed rezoning <br /> request is located. He stated that he concurs with the remarks made by Mr. Mihalache and mr. <br /> Whitacker and that the development has the solid backing of the neighborhood. <br /> Following discussion, Council Member Kelly made a motion, seconded by Dr. Varner that Bill <br /> No. 3-03 be recommended favorably to Council. The motion passed. <br /> Council Member Kuspa then called for a presentation on Bill No. 11-03 which is a request to <br /> establish an Historic Landmark for the structure and real property located at 130 Park Lane. <br /> Mr. John Oxian, President of the Historic Preservation Commission, made the presentation. He <br /> =� noted that the building is referred to as the "Junior League House" and is currently owned by <br /> Memorial Hospital. It depicts Colonial revisited architecture and is ranked "S 12". <br /> Documentation was then provided to the Committee which include copies of the handwritten HPC <br /> l Staff Report,minutes from the HPC meeting and pictures of the buildings. Mr. Oxian noted that if <br /> the buildings are moved in the future that language in the ordinance would designate that they <br /> would retain their Historic Landmark status. <br /> I <br /> I The Council Attorney questioned the purpose of the language in Section 3 of the ordinance. <br /> i <br /> Council Member Coleman also questioned the language in Section 3 of the ordinance. He asked if <br /> there was any precedent for the language proposed in Section 2 addressing a future move of the <br /> structures. <br /> Dr. Varner noted that the building moved to Devon Circle included language similar to Section 2. <br /> Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill <br /> No. 11-03 as to be amended be recommended favorably to Council. The motion passed. <br /> Council Member Kuspa then called for a presentation on Bill No. 12-03 which is a local historic <br /> landmark request for the structures and real property located at 1114 Lincolnway West. <br /> Mr. Oxian made the presentation. He noted that the structure is one of the finest examples of a <br /> Queen Anne house.
