Zoning and Annexation Committee <br /> 2005 South Bend Common Council. <br /> The April 11, 2005 meeting of the Zoning and Annexation Committee was called to order by its <br /> Chairperson, Council Member Ervin Kuspa at 3:50 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Council Members Pfeifer,Pu77ello,Kelly, Varner, Kuspa, White <br /> and Rouse; Building Commissioner Don Fozo, Director of Public Works Gary Gilot, City <br /> Engineer Carl Littrell, Rita Kopala,Don Inks, City Clerk John Voorde, Bernie Feeney, Andrew <br /> M. Videkovich, P. J. Thuringer, Kitty Kershan, Chris Tressell, David Mirkin, Pamela J. Tanber, <br /> Tiberius Mihalche and Kathleen Cekanski-Farrand, Council Attorney. <br /> Council Member Kuspa noted that the purpose of the Committee meeting was to consider the <br /> pros and cons of the items coming before it and make recommendations to the full Council. He <br /> noted that the Committee members include Council.Members Kirsits,Dieter,Rouse, and himself <br /> as the Committee Chairperson. Council Member Kuspa noted that there was not a quorum <br /> present. <br /> Council Member Kuspa then called for presentations on Substitute Bill No. 1-05 which is a <br /> rezoning request for the property located at 3400 Northside Boulevard, located in the 3rd <br /> Councilmanic District. <br /> P.J. Thuringer, a Planner with the Area Plan staff noted that the Bill received a hearing before <br /> the Area Plan Commission on March 15, 2005. The property owner is Family & Children's <br /> Center Property Management, Inc. and the contingent purchaser is Tiberius Mihalache of 117 <br /> South Main Street in Mishawaka. The rezoning would go from SF-2 and MF-1 to MF-1. It is <br /> sent to the Council without a recommendation. <br /> Council Member White inquired why there was no recommendation. Andy Laurent stated that <br /> the 1st vote of the Area Plan Commission was 7-3, and that 8 votes are needed in order to have a <br /> proper motion of the 15 members. <br /> The petitioner, Tiberius Mihalche, provided a multi-page handout to the committee (copy <br /> attached). He noted that the proposal is for condominiums and not apartments. Originally he <br /> proposed 54 condos,then amended it to 46, and is now proposing 36 units. He also proposed to <br /> increase the buffer area to 15', in light of the concerns of the neighborhood. He noted that the <br /> neighbors primary concerns were density and height of the project. He proposed that the highest <br /> would look like 1 1/2 stories from the street. In light of the concerns about possible wetlands, he <br /> contacted Mike Danch who has determined that there are no wetlands designated. With regard <br /> to flood plains, a small portion of the property is in such a 100 year flood plain area. <br /> Regulations require 692, and he currently has 690, in order to build. which would be subject to <br /> more expensive insurance requirements. He noted that 45% of the properties in the area are <br /> rentals. He proposes each condo to sell for over $100,000 each. He then circulated a site plan <br /> showing the 36 proposed units. <br /> Council Member Pn7zello expressed concerns regarding the hill on the property, and the <br /> petitioner pointed out its location on the site plan. <br /> April 11,2005 Zoning and Annexation Committee of the 2005 South Bend Common Council -page 1- <br />
