JOANN SPORLEDER: I will make a motion to approve of the change to use the extended oval pattern as presented, detailed and as illustrated. CATHERINE HOSTETLER: Seconds the motion. KAREN HAMMOND-NASH: Staff would beg for clarification here. Number one there is the change of the opening shape; but, also I think what Ms. Johnson was interested in is that the commission previously required that the original approaches be retained. What she is asking is that the commission approve of the removal and replacement of the approach rails. JOANN SPORLEDER: I will make an amendment to my motion that we approve of the replacement of the approach rails as outlined. CATHERINE HOSTETLER: Seconds the motion and it passes unanimously. III. REGULAR BUSINESS A. APPROVAL OF MINUTES (May) (None) B. LEGAL REPORT JOHN LIVINGSTON: There was a question that came up last month about the lawsuit for Madison School. Right now that litigation has been stalled and is dead from the standpoint that they did request a temporary injunction that was denied by the judge. So no action has taken place on that for about eighteen months. JOHN OXIAN: Are you talking about the Leeper Park parking lot? JOHN LIVINGSTON: Yes, the parking lot issue. I did talk with a John Strauss, who is with the school system. I guess when this thing gets straightened out there will—they're concerned that the lights are in the wrong place, that you were talking about. KAREN HAMMOND-NASH: Actually the problem is not that the lights are in the wrong place; but, that the C. of A. did not allow the installation of any lights. JOHN LIVINGSTON: Well it was clearly on the plan and you can see that when you look at it. GERALD UJDAK: Well it was never in any of the paperwork or in any of our actions.
