JOANN SPORLEDER: I will make a motion to approve of the change to use the <br />extended oval pattern as presented, detailed and as illustrated. <br />CATHERINE HOSTETLER: Seconds the motion. <br />KAREN HAMMOND-NASH: Staff would beg for clarification here. Number one there <br />is the change of the opening shape; but, also I think what Ms. Johnson was interested in is <br />that the commission previously required that the original approaches be retained. What <br />she is asking is that the commission approve of the removal and replacement of the <br />approach rails. <br />JOANN SPORLEDER: I will make an amendment to my motion that we approve of the <br />replacement of the approach rails as outlined. <br />CATHERINE HOSTETLER: Seconds the motion and it passes unanimously. <br />III. REGULAR BUSINESS <br />A. APPROVAL OF MINUTES (May) <br />(None) <br />B. LEGAL REPORT <br />JOHN LIVINGSTON: There was a question that came up last month about the lawsuit <br />for Madison School. Right now that litigation has been stalled and is dead from the <br />standpoint that they did request a temporary injunction that was denied by the judge. So <br />no action has taken place on that for about eighteen months. <br />JOHN OXIAN: Are you talking about the Leeper Park parking lot? <br />JOHN LIVINGSTON: Yes, the parking lot issue. I did talk with a John Strauss, who is <br />with the school system. I guess when this thing gets straightened out there will—they're <br />concerned that the lights are in the wrong place, that you were talking about. <br />KAREN HAMMOND-NASH: Actually the problem is not that the lights are in the <br />wrong place; but, that the C. of A. did not allow the installation of any lights. <br />JOHN LIVINGSTON: Well it was clearly on the plan and you can see that when you <br />look at it. <br />GERALD UJDAK: Well it was never in any of the paperwork or in any of our actions. <br />JOHN OXIAN: I informed Mr. Livingston that the legal committee should meet with <br />him to discuss this matter.
