• his opposition to continued designation, and that she felt he had been badly <br />misinformed as to the procedures and merits of theissues surrounding 'Dr. <br />Lackman's fence. She was disturbed that he seemed to have made' no effort to <br />confirm statements made to him by Dr. Lackman and that this reflected not only <br />on Mr. Duvall but also upon herself as she had chaired that meeting of the <br />commission: Mr. Talley indicated that priority should be given to verifying <br />that the deed restrictions indeed prohibited the fence. He then. asked what Mr. <br />Kelly's level of conflict might be should this issue reach the Common Council. <br />Mrs. DeRose indicated that she believed he would need to remove himself from <br />the vote but could address the council as an affected citizen. Mrs. Hostetler <br />recalled Mrs. Cekanski-Ferrand's remaining as counsel to the,Council in the <br />occasion of Mr. Laskowski's appeal despite her professional connections with <br />Mr. Laskowski's attorney. Mr. Oxian observed that this was true but that she <br />had responded to his remonstrance by taking a more neutral stand. Mr. Talley <br />asked if any information gathering had occurred in-house to rebut complaints <br />regarding the charges of authoritarianism against the commission. Mr. Duvall <br />stated that no such analysis had occurred to date, but that commission members <br />knew from experience that most applications were approved. Mr., Oxian indicated <br />that when a similar situation had occurred with Lincolnway East Historic <br />District that such analysis had been done and had persuaded the councilmen at <br />that time to withdrawn support of the petitioners. He indicated that it was <br />very important to develop this information. <br />4. Historic Districts <br />Mrs. Choitz reported that the committee had met to review the schedules stated <br />. for review of the District Standards and prepared preliminary materials and <br />meeting arrangements for Project Access to address public relations problems <br />in the Historic Districts, starting with East Wayne Street-. She felt it was <br />important to discuss the issues reading the movement to remove the Wayne <br />Street District and announced that she would have an open house on the <br />following Wednesday evening to entertain such discussion. <br />Mrs. Sporleder recalled that long ago it had been discussed to record the <br />Local Landmark Designation so that this status -would come to light in any <br />title search. Mr. Talley observed that although the recording had been <br />accomplished, that there was a possible glitch. Mr. Duvall indicated that in <br />his discussions with title company representatives it became clear that .the <br />reporting of these restrictions was discretionary on the part of the title <br />companies. Mrs. DeRose indicated that it was not legally possible to force the <br />title companies to report this information. She indicated that the commission <br />could contact the local companies and request that they pick-up this <br />information. Mrs. Sporleder indicated that it would be helpful if somehow the <br />commission was notified of title transfers. Mr. Talley suggested that this <br />might be possible through computer networking. Mrs. DeRose indicated that it <br />might be valuable to provide the current landmark and district address lists <br />along with the letter to the title companies. Mr. Duvall indicated that this <br />could be done. Mrs. Sporleder asked how the ownership database could be kept <br />current. Mrs. Choitz stated that currency was a problem with any mailing list. <br />Mr. Duvall indicated that an interval should be determined at which the <br />addresses would be rechecked, be it annually, semi-annually or quarterly. Mr. <br />Oxian stated that he thought once a year seemed reasonable. Mrs. Choitz <br />• indicated that when time came for an early -in -the -year notification the <br />addresses should be checked. Mrs. Choitz asked if the commission could make a <br />greater requirement of the County Administration to assist in this record <br />keeping. Mrs. DeRose indicated that they have no obligation to do more than <br />record the deeds. <br />5. Historic Landmarks <br />
