A <br />discussion on the ability of a Designated Local Historic District to change <br />it's standards ensued briefly. <br />Commissioner Sporleder turned the discussion to the topic of public hearings <br />and inquired if the HPC's hearings are similar to Area Plan public hearings in <br />that all property owners within the proposed district are notified as well as <br />all property owners within 300 feet of the established boundaries. President <br />Oxian replied the HPC public hearing are conducted in the same manner in <br />regard to notification. <br />5. Historic Landmarks <br />a. First reading on landmark status for the following properties: <br />none <br />b. Second reading on landmark status for the following properties: <br />310 West Monroe <br />Presidc�i,L Oxian noted the conflicting situation involving the designation of <br />this property. He stated the property is still owned by the city of South <br />Bend, but the Zion Hill Baptist Church wants to purchase it. President Oxian <br />reported the city had told the Commission they could landmark the structure, <br />but the HPC received a letter from the prospective buyers stating they do not <br />want the property landmarked. President Oxian read the letter from the <br />congregation asking that the consideration for the designation be removed. <br />Legal Council DeRose stated she believed the congregation had no standing to <br />challenge the designation if they do not own the property. She noted the HPC <br />could defer hearing for 90 days to see if the Zion HIll Baptist Church would <br />be the successful bidder, or the Commission could go ahead with the <br />designation. Mr. Duvall assessed the situation as confounding and noted the <br />HPC had delayed the second hearing at the request of Economic Development. He <br />added they had notified the HPC that they had finalized the plans for the sale <br />and the transfer would occur in October with the interested purchaser knowing <br />Economic Development was in support of the landmarking. Mr. Duvall stated he <br />was led to believe the prospective purchaser was at least not opposed. He <br />noted the letter was received by the Staff September 19, 1994. <br />A discussion involving the Zion Hill Baptist Church's right to challenge the <br />designation followed. Commissioner Choitz suggested that nomination should go <br />forward without the consent of the prospective buyer. Commissioner Choitz <br />moved that the property at 310 West Monroe be recommended for designation as a <br />local landmark. Commissioner Wiener seconded the motion. The motion was Passed <br />unanimously. <br />1601 Kemble Avenue (Toth State Bank) <br />President Oxian reported the Commission had approached this and a neighborhood <br />bank on South Michigan Street about landmark designation, and the S. Michigan <br />building is still in discuss. He noted that the HPC had not heard one way or <br />the other from the 1601 Kemble Avenue bank. President Oxian moved that the <br />Property at 1601 Kemble Avenue be recommended for designation as a local <br />landmark._ noting that the property is across from another landmark, Oliver <br />School. Commission Petrass seconded the motion. The motion Passed unanimously., <br />534 LaPorte Avenue (Starzynski Texaco Gasoline Station) <br />President Oxian noted the structure is one of the last gas stations of its <br />type, and that it retains many origin not <br />features, though it is not in use. He <br />noted—that—because--the -t-dx-e-s—have not been paid, it is in the hands of the <br />County. President Oxian moved that the r)roDertv at 534 LaPorte Avenue be <br />recommended for desip:nation as a local landmark. Commissioner Choitz seconded. <br />
