(2) Such standards shall be applicable only to the exterior features of Historic Landmarks and of buildings or structures within Historic Preser- vation Districts. E. Section 21 -117.2 shall be amended by the deletion in its entirety of existing sub - section (j) and by the addition thereto of the following new sub - sections (j) and (k): (j) Acquire or accept throuah gift, grant, legacy, bequest, or endowment, monies and preservation easements in real property for the purpose of historic preservation. Expenditures of such money, regardless of the source, must be deposited in a special Historic Preservation Commission account, and receive prior approval from the Common Council before expenditures may be made. (k) The Historic Preservation Commission may bring legal action to enforce the provisions of this article. Section II. Article 9 of the Municipal Code of the City of South Bend, Indiana, shall be amended as follows: A. Section 21- 16.6(a) shall be amended to read as follows: (a) Any person or anyone acting in behalf thereof who violates or fails to comply with any of the provisions of this chapter with the exception of the provisions of Article 8, Subdivisions, shall be guilty of a misdemeanor and upon conviction there of shall be fined not less than Ten Dollars ($10.00) and not more than One Thousand Dollars ($1,000.00), except that a violation of or a failure to comply with any of the provisions of Article 6.5, Historic Preservation Commission, shall be subject to a fine of not less than Fifty ($50.00) Dollars and not more than Two Thousand, Five Hundred ($2,500.00) Dollars. Each day that a violation is permitted to exist shall constitute a sep- arate offense. Any building erected, raised, converted, or land or premises used in violation of any provisions of this chapter or the requirements thereof, is hereby declared to be a nuisance and such nuisance may be abated in such manner that nuisances are now or may hereafter be abated under existing law. B. Section 21- 166(c) shall be amended to read as follows: (c) The City Attorney shall immediately upon any such violation having been called to his attention, in- stitute injuction, abatement or any other appropriate action to prevent, enjoin, abate or remove such violation, except that in the case of any such violation of anv pro- vision of Article 6.5, Historic Preservation Commission, in which the City Attorney does not institute such action, then such action to prevent, enjoin, abate or remove such violation may be instituted by and on behalf of the His- toric Pres Commission by a attorney employed b
