(2) Such standards shall be applicable only to the <br />exterior features of Historic Landmarks and of <br />buildings or structures within Historic Preser- <br />vation Districts. <br />E. Section 21 -117.2 shall be amended by the deletion in <br />its entirety of existing sub - section (j) and by the addition <br />thereto of the following new sub - sections (j) and (k): <br />(j) Acquire or accept throuah gift, grant, legacy, <br />bequest, or endowment, monies and preservation easements <br />in real property for the purpose of historic preservation. <br />Expenditures of such money, regardless of the source, must <br />be deposited in a special Historic Preservation Commission <br />account, and receive prior approval from the Common Council <br />before expenditures may be made. <br />(k) The Historic Preservation Commission may bring <br />legal action to enforce the provisions of this article. <br />Section II. Article 9 of the Municipal Code of the City of South <br />Bend, Indiana, shall be amended as follows: <br />A. Section 21- 16.6(a) shall be amended to read as <br />follows: <br />(a) Any person or anyone acting in behalf thereof <br />who violates or fails to comply with any of the provisions <br />of this chapter with the exception of the provisions of <br />Article 8, Subdivisions, shall be guilty of a misdemeanor <br />and upon conviction there of shall be fined not less than <br />Ten Dollars ($10.00) and not more than One Thousand Dollars <br />($1,000.00), except that a violation of or a failure to <br />comply with any of the provisions of Article 6.5, Historic <br />Preservation Commission, shall be subject to a fine of not <br />less than Fifty ($50.00) Dollars and not more than Two <br />Thousand, Five Hundred ($2,500.00) Dollars. Each day that <br />a violation is permitted to exist shall constitute a sep- <br />arate offense. Any building erected, raised, converted, <br />or land or premises used in violation of any provisions of <br />this chapter or the requirements thereof, is hereby declared <br />to be a nuisance and such nuisance may be abated in such <br />manner that nuisances are now or may hereafter be abated <br />under existing law. <br />B. Section 21- 166(c) shall be amended to read as <br />follows: <br />(c) The City Attorney shall immediately upon any <br />such violation having been called to his attention, in- <br />stitute injuction, abatement or any other appropriate <br />action to prevent, enjoin, abate or remove such violation, <br />except that in the case of any such violation of anv pro- <br />vision of Article 6.5, Historic Preservation Commission, <br />in which the City Attorney does not institute such action, <br />then such action to prevent, enjoin, abate or remove such <br />violation may be instituted by and on behalf of the His- <br />toric Pres Commission by a attorney employed b <br />
