Extensive revision of the ordin- <br />ance should be co-ordinated with the comprehensive revision of the <br />City and County Zoning Ordinance now underway by the Area Plan <br />Commission. <br />The immediate and minimal changes proposed by Mr. Dunfee covered <br />three main points: <br />1. The deletion of the part of Section II concerning the ac- <br />ceptance by the Commission of "real estate, personal -- <br />property, or monies for the purpose of historical preser- <br />vation." Mr. Dunfee pointed out that this clause gave us <br />illegal powers, since the Commission cannot own property. <br />2. The insertion of the words. "Historic Preservation District" <br />into Section II, 2,e of the Ordinance concerning the estab- <br />lishment of reasonable and just standards. This addition <br />merely clarified the jurisdiction of the Commission. <br />3. The third change involved the zoning of Historic Preser- <br />vation Districts. Mr. Dunfee advised the adoption of an <br />overlay zoning which would merely superimpose an historic <br />district over the present zoning. In such a case, the <br />zoning classification of -specific buildings would not be <br />affected. For example, A-1 residential would remain A-1 <br />as such, with Historic Preservation ordinance provisions <br />applicable in addition to A-1 standards. Whereever a - <br />conflict would occur between Historic Preservation pro- <br />visions and zoning ordinance provisions, the Historic <br />Preservation provisions would prevail. <br />Mr. Dunfee said that the three changes should be incorporated into <br />the ordinance and the ordinance then would be free from challenge. <br />The Area Plan Commission and staff had reviewed and approved this <br />revision. After some discussion, Mr. Rothermel moved that the <br />Commission accept the recommendations for the ordinance and that <br />they be turned over to the Area Plan Commission. Mr. Nimtz se- <br />conded the motion and it was passed unanimously. <br />Mr. Jack Smith thanked Mr. Dunfee again and repeated how in- <br />debted the Commission is to him and his work in the Commission's <br />behalf. <br />Presidential Report <br />Mr. Smith remarked that the Commission should do something about <br />the Studebaker Mausoleum which is in bad shape. It was suggested <br />that the Landmarks Committee pursue this matter. Ms. Price spoke <br />about its history and said it was no longer considered the Stude- <br />baker Mausoleum and that the name "Studebaker" had, as a matter <br />of fact, been removed from the tomb. It was decided the Commission <br />should take no action. <br />
