or blasters, air hoist operators, form men, concrete blower operators, cement operators, <br />power knife operators, erector operators, steel setters, cage tenders, skinners, track layers, <br />dumpmen, diamond drillers, timbermen and re-timbermen, cherry pickmen, nippers, <br />chuck -tenders and cable tenders, vibratormen, jet gunmen, gunnite nozzlemen, gunmen, <br />reboundmen and all other work connected therewith. <br />23. Railroad Track Work: Right-of-way clearing, excavation, grading and sub - <br />grading, ballasting and compacting of right-of-way; loading, unloading, stockpiling, <br />handling and distribution of track and ties and placing of or jacking track and ties at point <br />of installation; all burning or otherwise cutting of track; setting of tie plates, bolting, <br />leveling and gauging of rails and all spiking, whether by hand or mechanical means, <br />placing and tamping of ballast by hand or mechanical means; construction and/or <br />relocation of mainlines, shoe flys, sidings, gradings, crossings, relocating of pipes and <br />drainage and culverts. <br />24. Asbestos Removal/Lead Base Paint Removal, Lead Awareness, Hazardous <br />Waste Removal and Infection Control Risk Assessment: All work in regards to the <br />dismantling, wrecking, clean-up, dilution process, loading, transporting, operation of <br />monitoring equipment, etc. <br />25. Fire Prevention and Control: Shall include but not be limited to the watching <br />for and prevention of fires (with a fire hose or fire extinguisher or other means) when there <br />is welding, burning, grinding, etc., being performed in an area where combustible <br />materials are present. Upon request of the Contractor, these Employees shall have <br />completed the Laborers Training Course in Fire Prevention and Control. <br />26. Sinking of wellpoints, installation of dewatering header systems. <br />27. Bobcats, Skidsteer Loaders, forklifts and lulls, including those machines <br />equipped with small jackhammers (special breakers) may be assigned Laborers for the <br />following work: <br />(a) building demolition work (inside the structure). <br />(b) minor excavation such as curb tear out and replacement. <br />(c) incidental use throughout the project <br />Section 2. Jurisdictional Disputes: <br />a) The Employer agrees to respect the jurisdiction of the Union and shall not make a <br />written or a permanent assignment of work to other Trades without first affording Parties <br />to the disputed work an opportunity to present evidence substantiating their claims. The <br />Employer does not waive any of his rights by permitting the inclusion of jurisdiction of <br />7 <br />
