All employees are subject to a pre -hire drug screen. This test and negative test results are <br />required to be eligible for employment. Employees and applicants are subject to testing for the <br />presence of alcohol, drugs, or controlled substances. Testing will be at the discretion of <br />BERGLUND or otherwise in compliance with applicable laws concerning drug and alcohol testing. <br />Testing procedures are intended to protect individual privacy, ensure accountability and integrity <br />of the specimens, and provide confidentiality of test results. A certified laboratory will perform all <br />tests. <br />6. Drug type <br />Employees will be testing for the following drugs: <br />Amphetamines Barbiturates <br />Cocaine Benzodiazepenses <br />Marijuana Proporyphene <br />Opiates Methadone <br />Phencyclidine (PCP) <br />7. Applicant Screening <br />Applicants being considered for employment will be subject to pre -employment screening for <br />drugs and alcohol as set forth above. A positive result from such screening tests will be grounds <br />for denying or revoking employment to the applicant. <br />8. Reasonable Suspicion <br />Employees will be tested if there exists a "reasonable suspicion" that the employee is under the <br />influence or impaired by alcohol, a controlled substance, or other drug. Any corporate office is <br />authorized to require testing. Tests will be performed in accordance with this policy using blood <br />and / or urine samples collected from the employee. A positive test result will be grounds for <br />immediate discharge. Refusal to submit to a request for testing for the presence of alcohol or <br />drugs will give rise to a presumption of intoxication or usage and such refusal shall also constitute <br />insubordination and be grounds for immediate discharge. <br />Observations leading to a determination of reasonable suspicion include, but are not limited to, <br />the following: <br />8.1 Drinking of alcohol or use of unlawful drugs or other controlled substances <br />8.2 Slurred speech <br />8.3 Unsteady gait or posture <br />8.4 Erratic behavior <br />8.5 Disorientation and confusion <br />8.6 Inability to perform routine tasks <br />8.7 Disorderly appearance in dress or grooming <br />8.8 Odor of alcohol or other ingested substances <br />8.9 Proximity to discovered substances or containers reasonably believed to be or hold <br />alcohol or drugs <br />8.10 Glassy or red eyes or other characteristics associated with the use of alcohol or other <br />drugs <br />8.11 Any accident or incident on or off company premises while conducting company business <br />or while on duty which results in personal injury or property damage where it is <br />reasonably to suspect that human error could be at least in part at issue. For drivers <br />subject to DOT-FHWA regulations, in addition the above, testing will be required after any <br />reportable accident for which the employee receives a citation for a moving traffic <br />violation. Reportable accidents include those which involve the following: <br />8.11.1 A fatality, or <br />87 <br />
