FM 1lth..1919.' Cont inuod'-_ SIDEWALK IMPROVEMENT RESOLUTION NO. 636. Resolved by the Board .of Public Works ofthe City . of South Bend, St. Joseph' County, State of Indiana, that it. is deemed necessary to improve .the west side of Michigan 'Street from the ' south line of Third `Addition to Oa.kside to a; point 750 feet south of 'the south line * of Chippewa Avenue as folle4s, to -wit: �- By making the neessary excavation and' constructing cement walk on the west' side of Michigan Street from the south line of the Third Addition -to Oaksidf to a _point 750 feet south of : the south Tine of Chippewa, Avenue; all as is more partinularly sho.vn and all in accordance with the plans, profiles, detail drawings and specifications on file in the jiff ice of the . Department of Public Works of the City of South 'Bend, Inci � ana, _ and such improvement- is ;now ordered. The cos of said improvement; including'the cost of the street and alley intersections,, shalh be . assessed upon' -the real estat.e abutting on said west side of. Michigan Street all according to he method and amnner provided for in an wet of of the '-deneral Assembly of the State of Ind.Iana, eneitlted " An Act Concerning Muneiopal Corporations,,." approved March 6,1905. and in accordance with and pursuant 'to the provisions of all amendatory and supplemental acts theretot- passed by the General Assembly of the State of Indiana, Assessments, if .defered- are to be: paid in ten equal annual ,installments,, with interest 'at the rate of, six per cent per annum. A bend or bonds shall be issued to the contractor . in payment of such work, un- less the property owners pay said assessment before said bond or bonds are issued. Under no a ircumstgnces shall the City of South Bend be, it be held responsible for any sum or sums due from said property owner or owners for.said work or for the oolleetion of the same, or for the payment of any bond, bonds, -certificate or certi- ficates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assesments for such improvement, or such moneys as said` City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement; assess- ment of property, collection of assessments and issuance of bonds therefor shall be as provided for in said above entitled Act and amendments thereto. Notice of this resolution shall be published on the 13th. , day of March 1919 and on the 20th.9 day of March 1919. in the South Bend Daily Tribune This Board will give a hearing on this resolution in its office in the City Hall on the 2nd. , day of ApAll 1919 at 7:15 P.M.
