<br />BE IT RESOLVED'BY THE BOARD OF PUBLIC WORKS OF THE CITY 0? SOUTH BEND
<br />STTJOSEHH COUNTY STATE OF INDIANA, .that it desired and deemed necessary to improve
<br />Eddy Street from Mishawaka Avenue. to Samplt `Street Bridge as followsm towitt:-
<br />Said street shall be graded and the roadway {hereof shall be paved; and
<br />also the roadway of certain portions of the streets and alleys which (enter or
<br />intersect said street shall.'be graded,and paved. The paving material to be used In.
<br />making said improvement shall be -Sheet ;Asphalt, Bitulithic, Asphaltic concrete„ or
<br />Brick, and the foundation shall be Portland ceMInt concrete five (g) inches thick
<br />for .that sheet; asphalt, 'bitulithic,,�, asphaltic concrete and brick., or 'rolled gravel
<br />;,ix {6), inches thick for the Brick; also the cement curb now in place or, said .street
<br />shall be taken out and;,a combination curb and gutter shall be constructed
<br />along said street; storm water inlets ;a,rLd conduits shall be constructed where
<br />nec-essary; all manhole tops.and storm;wa,ter.inlets shall be set to the proper
<br />grade; cement marginal curb shall be constructed'at all streets and alleys where
<br />necessary, all as is more particularly shown and all in accordance -with the plans,
<br />,profiles, detail drawings and specif icat ions on f ilea in the office of the Department
<br />df Public Works of the City of South Bend, Indiana:

<br />ally assessed therefor, in accordance with an Act of the General Assembly J4 *s . State Of ludiana, en
<br />"An Act Concerning Municipal Corporations," approved lhnmh 0, 1905, td;l¢ accordance with and puni"ut
<br />to oils Drb www of all am ame2414M and iapplemental Thereto.
<br />The cost of all street and alley. intersections, including one-half of the width of the improvement onno-
<br />site street and alleys which run into, -but do not cross said roadway herein proposed to be improved and that
<br />portion of such street or alley abutting upon property belonging to said City, or upon property not subiect to
<br />sueh assessment, shall be paid by the .City. in cash out of its. general fund, if able to do so, or from a fund cre-
<br />ited by a special assessment to be bevied under the provisions of Section 109 of the above entitled Act.
<br />Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual in-
<br />stallments, with interest at the rate of Six per cent per annuity. A bond or bonds will be issued to the 004-
<br />tligor to the amount of such deferred assessments in pro rota payment for such improvement.
<br />Under no circumstances shall the city of South Bend be, or be held responsible for any sum or sums d
<br />from said property owner or owners for said work, or for the collection of the same, or for the payment of any9
<br />bond, bonds, certificate, or certMeatrm, issued. to said contractor in payment for such work, except for such
<br />moneys as shall have actually been received by the City from the assessments for such improvement, or Such
<br />moneys as said City is by said entitled -Act and amendment and supplements. thereto required to pay. All.
<br />proceedings had, and work done in the making of said improvement, assessment of property, collection of as-
<br />sessments and issuance of bonds therefor, shall be as provided for in said above entitled Act, and Acts amend-
<br />MW thereof and supplemental thereto.
