REGULAR MEETING DECEMBER 11 2018 393 <br />if the property to be sold is one (1) item with an estimated total value of $1,000 or more, or is <br />more than one (1) item with an estimated value of $5,000 or less; and <br />WHEREAS, the Board has determined that the Property has an estimated value of less <br />than $5,000,and the Board has further determined that the property is unfit for the purpose for <br />which it was intended, and is no longer needed by the City of South Bend; and <br />NOW, THEREFORE, the Board of Public Works of the City of South Bend hereby finds <br />that the Property listed at Exhibit "A" is no longer needed by the City; the Property is unfit for <br />the purpose for which it was intended, and has an estimated value of $5,000 or less. <br />BE IT RESOLVED that the Property may be transferred or sold at public auction. <br />However, if the Property is deemed to be worthless, such Property may be demolished or junked. <br />ADOPTED the I ITH day of DECEMBER, 2018. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/ Gary A. Martin, Clerk <br />ADOPT RESOLUTION NO. 68-2018 — A RESOLUTION OF THE BOARD OF PUBLIC <br />WORDS OFTHE CITY OF SOUTH BEND INDIANA APPROVING THE ACCEPTANCE <br />OF TRANSFERS OF REAL PROPERTY <br />Upon a motion made by Ms. Maradik, seconded by Ms. Doran and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO, 68-2018 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA, <br />APPROVING THE ACCEPTANCE OF TRANSFERS OF REAL PROPERTY <br />WHEREAS, the City of South Bend, Indiana, Board of Public Works (the `Board") is <br />empowered to purchase, acquire, and lease property on behalf of the City of South Bend, Indiana <br />(the "City") pursuant to Indiana Code Section 36-9-6-4 (the "Code"); and <br />WHEREAS, the Board, on behalf of the City of South Bend, Indiana Department of <br />Community Investment ("DCI"), along with the Urban Enterprise Association of South Bend, <br />Inc. (the "UEA"), entered into that certain agreement, dated _September 12, 2014, with the <br />Indiana Housing and Community Development Authority Blight Elimination Program <br />("IHCDA"), wherein IHCDA granted an award to the City through DCI to work with UEA to <br />acquire and demolish blighted residential structures and facilitate an end use for the newly vacant <br />lots (the "Agreement"); and <br />WHEREAS, the UEA agreed to work with the City under the terns of the Agreement, so <br />long as the City took ownership of any properties acquired thereunder and still owned by the <br />UEA upon the termination of the Agreement; and <br />WHEREAS, in accordance with the Agreement, the UEA acquired and continues to own <br />certain real property described on Exhibit A (the "Property"); and <br />WHEREAS, due to the termination of the Agreement, the UEA desires to transfer the <br />Property to the City and DCI desires the Board to accept the donation of the Property pursuant to <br />the Code and in furtherance of the terms of the Agreement; and <br />WHEREAS, the Board desires to authorize DCI staff to perform certain actions on the <br />Board's behalf to effectuate the acquisition of the Property. <br />
