Area Board of Zoning Appeals—February 1, 2012 <br /> needs to be functioning and useful so it would help preserve the neighborhood. We don't think that use will <br /> adversely affect or injure the neighborhood in anyway, in fact we believe it will help it. We believe again, as <br /> we stated, that it's consistent with the character of the neighborhood to have this nightclubibar there. All <br /> along Western Ave. from literally from Walnut to even beyond Olive Street you can see many, many, many <br /> clubs and bars and restaurant and other commercial uses along that portion of the street. And finally we <br /> think that this is a use that is certainly compatible with not just what's in the neighborhood but what the <br /> intentions are with regard to that particular corridor. Thank you and we'll entertain any questions you may <br /> have. <br /> MR. FEDDER: I think the staff made a comment. <br /> MS. NAYDER: Our comment was favorable based on seeing a parking agreement. Now we do have a <br /> parking agreement, it's still kind of a big, it's about a75% reduction in parking. And I was trying to kind of <br /> look through the parking calculations here to figure out if any other businesses would have less parking or if <br /> this size of a building be based upon the way we calculate the parking calculation that if any use that goes in <br /> here is going to need this many parking spaces. We would like to see the building be re-used. We don't <br /> want the parking situation to adversely affect it so, there's been some good progress made with the parking <br /> agreement that we do have and it's good that is on the record. I mean we looked at if it was like a doctor's <br /> office and they only had one doctor they'd only need five parking spaces. That's just one example. <br /> MR. URBANSKI: We need a motion on the parking variance first. <br /> MR. VELLEMAN: Mr. Chairman I'll make a motion to approve the variance requested to the on site and <br /> the 22 off site per lease agreement. It sounds like it's the same agreement that was on hand for the former <br /> Seahorse and was not a problem at that time. They potentially have more people but I would say we grant <br /> the variance requested subject to the City Council approving the Special Exception. <br /> MR. YOUNG: I'll second. <br /> MR. URBANSKL We have a motion and a second, call for the vote. This is on the variance portion of it. <br /> Call for the vote. <br /> The motion carried unanimously. <br /> MR. HAWLEY: I would like to make a motion that we send it to the Common Council with no <br /> recommendation. <br /> MR. URBANSKI: Do we have a second? Do we have a second? The motion dies for the lack of a second. <br /> MR. PHIPPS: If there's no second I will make a motion to send it with and Unfavorable Recommendation. <br /> Although I voted in favor of the variance with the condition that the City Council approves I'm willing to let <br /> the decision rest with the City Council and am still uncomfortable at 27 spaces so I would recommend <br /> 56 <br />
