Area Board of Zoning Appeals —February 1, 2012 <br /> MS. WHITE: No. Mr. George owns the home. I've been there for 16 years to take care of him. I pay him <br /> rent. He's sitting there but he doesn't hear well, <br /> MR. HAWLEY: You're a caretaker for him? <br /> MS. WHITE: Yes. <br /> MR. HAWLEY: Oh, I see. Thank you. <br /> REBUTTAL: <br /> MR. LANG: Basically the petition before you for this Special Use or Special Exception, the map itself <br /> shows we have 46 neighbors in support of the use of the day care here. We have one resident caddy corner <br /> across the street on the other side of the alley from where we're located and by their terms the parking has <br /> gotten better since we've instituted the parking changes that have come to our attention. The fact that the <br /> staff is now parking down at the church, the time frame in which the kids are dropped off and picked up, I've <br /> done it myself when my daughter was younger. You know fly in and 3 minutes it takes for the kid to get his <br /> coat and boots on or whatever and then you're out the door, is a time frame that my get expanded. All of the <br /> people now that have children at the facility are aware of the policy and that they need to go to the off street <br /> parking if they're going to be longer than that time frame. The use of the property I think from all the letters <br /> of support and the community people that have also given letters in this packet shows that there was a <br /> demand for this type of facility. It's high quality. It's very well controlled. Educational atmosphere for the <br /> children and it wouldn't have that kind of support from the neighbors and from the community if wasn't a <br /> first class operation and I think the continued use of it with the changes that the staff has made over that <br /> month's time frame when the transition was taking place through this, it shows that it's already gotten better <br /> from what the comments were made. <br /> MR. PHIPPS: Terry just to clarify, are you in agreement then that you're request for variances are not <br /> required and that we should only be voting on our recommendation on Special Exception? <br /> MR, LANG: It is strictly a recommendation for the Special Exception is what we are asking for. <br /> A motion for approval was made by Mr. Phipps and seconded by Mr. Hawley. The motion carried <br /> unanimously. <br /> After hearing the evidence on the petition, the Area Board of Zoning Appeals find that you did satisfy <br /> the Standards as set forth in I.C. 36-7-4-918.5; therefore, the petition was sent to the Common <br /> Council with a Favorable Recommendation. <br /> Based on the testimony presented, the Area Board of Zoning Appeals, after careful consideration, finds this <br /> Special Exception sent to the Common Council with a Favorable Recommendation and will issue written <br /> Finding of Facts. <br /> PETITION FOR SPECIAL EXCEPTION IS SENT TO THE COMMON COUNCIL WITH A <br /> FAVORABLE RECOMMENDATION <br /> 29 <br />
