SUPPLEMENTAL AGREEMENT NO. 1 <br />This Supplemental Agreement No. 1 is made and entered into this q day of On", 20_U), <br />by and between the City of South Bend, Indiana, acting by and through the Board of Public Works, <br />hereinafter referred to as the "Owner", and DLZ Indiana, LLC, 2211 East Jefferson Blvd., South Bend, IN <br />46615, hereinafter referred to as the "Architect -Engineer". <br />WITINESSETH <br />WHEREAS, the Owner and Engineer did, on August 28, 2018 enter into an agreement for the <br />Damage Inspection Investigation for the north wing of the lower level of the Century Center (Project No. <br />118-082 and Code cc2018) <br />WHEREAS, during the course of Project, certain additional services not included in the original <br />contract dated August 28, 2018, have become necessary; specifically: <br />• Preparation of Contract Documents <br />• Bidding Services <br />• Construction Administration Services <br />NOW THEREFORE, the Owner and the Engineer desire to amend the above referenced Design <br />Contract as follows: <br />Agreement <br />A. Section L01 Basic Agreement and Period of Service <br />1. REVISE paragraph B as follows: <br />B. Architect/Engineer shall complete its services within a reasonable time, or <br />within the following specific time period: <br />a. Investigative Study: September 19, 2018. <br />b. Prepare Draft Construction documents (CD): within 3 weeks <br />from Notice to Proceed from the Owner. <br />Prepare final CD plans within 1 week of review of Draft CD plans <br />by Owner. <br />Construction anticipated to be completed within approximately <br />8 weeks from award of Construction Contract by the Owner. <br />B. Section 7.01 Basis of Pavment--Lump Sum and hourly rate <br />1. REVISE paragLaph A as follows: <br />A. Using the procedures set forth in Paragraph 2.01, Owner shall pay <br />Architect/Engineer as follows: <br />1. A Lump Sum amount of $43,900.00, plus <br />2. A not to exceed amount of $6,000.00, based on hourly rate of <br />actual work performed. <br />3. Total Basis of Payment: Not to Exceed $49,900.00. <br />II. Part 1— Basic Services <br />A. Paragraph A1.01 Design Services <br />1. ADD paragraphs B, C & D as follows: <br />B. Prepare Construction documents (Lump Sum) <br />A. The Architect/Engineer, shall provide the following: <br />a.
