ARTICLE XIV <br />PLAYER DEVELOPMENT CONTRACT AND LIQUIDATED DAMAGES <br />Section 14.01 MAINTENANCE OF PLAYER DEVELOPMENT CONTRACT. The <br />Team represents that it has, as of the date of the execution of this Stadium Agreement, a legally <br />binding Player Development Contract with the Arizona Diamondbacks. During the term of this <br />Stadium Agreement, the Team shall maintain a Player Development Contract with the Arizona <br />Diamondbacks or such other successor major league baseball team that may be obtained. The <br />Team agrees to refrain from any conduct or activities which would cause it to breach its current <br />Player Development Contract or any successor Player Development Contract(s). Should the <br />Team lose its Player Development Contract or any successor Player Development Contract and <br />not be able to provide to the Park Board adequate assurance that a Player Development Contract <br />will be obtained at a specific future date acceptable to the Park Board or, with the approval of the <br />Park Board, not be able to provide a competitive team acceptable to the Midwest League, or <br />such other league of Class "A" or above which may in the future have the authority to grant the <br />Team the right to play within the City of South Bend, without a Player Development Contract, at <br />the option of the Park Board, this Stadium Agreement shall be terminated. The Team agrees <br />that it will not engage in any act or deed which will result in the loss of its Player Development <br />Contract or removal from the City or in the playing of the Team home Baseball Season schedule <br />elsewhere. The Team shall, during the term of this Stadium Agreement, abide by all rules and <br />regulations of the Midwest League and of the National Association of Professional Baseball <br />Leagues. <br />ARTICLE XV <br />PARKING <br />Section 15.01 USE OF PROPERTY SURROUNDING THE STADIUM. The Park <br />Board shall during the term of the Stadium Agreement maintain the property which it owns <br />surrounding the Stadium structure as parking for the use of persons attending events at the <br />Stadium. <br />Section 15.02 CLAEYS CANDY LOT. The Team acknowledges that the Park Board <br />has entered into a Lease Agreement with Claeys Candy, Inc. ( "Claeys ") for the use of certain real <br />property owned by Claeys for on -site parking with Claeys retaining the use of a portion of said <br />property during certain hours for its manufacturing operations. <br />Section 15.03 SNOW REMOVAL FOR ON -SITE PARKING. The Park Board shall <br />remove snow from the on -site parking areas and shall assure that the Team has access to its on- <br />site staff parking spaces on a year -round basis. <br />Section 15.04 SUPPLEMENTAL PARKING. The Park Board and the City of South <br />Bend shall utilize their best efforts to obtain supplemental parking in close proximity to the <br />Stadium site and shall make any such property obtained or leased available to persons attending <br />all Team Events, Team Special Events, and Park Board Events in the Stadium. <br />
