or damage to personal property of the Team, its employees and players, players for opposing <br />teams, umpires, concessionaires, employees and agents of concessionaires, stadium attendees, <br />and others, except to the extent that such loss, theft or damage is from the act of the Park Board, <br />its employees, agents or sub - contractors. <br />Section 13.04 REQUIRED POLICIES OF INSURANCE. The Team shall, effective as <br />of January 1, 2009, and thereafter during the term of this Stadium Agreement, keep in full force <br />and affect the following policies of insurance: <br />Comprehensive general liability insurance, including products liability insurance against <br />any and all claims and losses arising out of its activities under this Stadium Agreement in <br />the following minimum amounts: <br />- Personal Injury - $1,000,000.00 each person and each accident, $1,000,000.00 <br />aggregate <br />Property Damage - $1,000,000.00 each incident; $1,000,000.00 aggregate <br />- Umbrella Liability Coverage and Umbrella Liability Policy in an amount not less <br />than $4,000,000 for any one occurrence in excess of the aforementioned general <br />liability insurance. <br />Dram Shop - a certificate obtained either by the Team or Service America or such <br />other successor Food and Beverage Service operator providing Dram Shop <br />liability coverage naming, in the case of a certificate provided by Service <br />America or such other successor operator, the Team, the Park Board and the City <br />of South Bend as additional named insureds or, in the case of a certificate <br />provided by the Team, naming the Park Board and the City as additional named <br />insureds with the amount of the coverage identical to that of the comprehensive <br />general liability coverage as required herein. <br />- Workers Compensation - the Team shall provide and keep in full force and effect <br />during the term of this Stadium Agreement, workers compensation insurance in <br />full compliance with the laws of the State of Indiana. <br />Section 13.05 NAMED INSUREDS AND CERTIFICATES OF INSURANCE. All of <br />the insurance policies described in Sections 13.04 herein shall show the Team, the City of South <br />Bend and the Park Board as named insureds as their interest may appear. All such policies shall <br />contain an endorsement giving the Park Board ten (10) days prior written notice in advance of <br />any material alteration or cancellation of said policies. All such insurance policies shall be <br />written by companies authorized to do business in the State of Indiana. <br />Section 13.06 INSURANCE PROVISIONS IN TEAM'S CONTRACT FOR FOOD <br />AND BEVERAGE SERVICES. The Team shall not permit a modification in the insurance <br />provisions of its Food and Beverage Service Contract as approved by the Park Board in Section <br />6.03 above during the term of this Stadium Agreement. <br />
