from areas other than the Team Souvenir and Novelty Areas. The Team shall have the right to <br />approve the sale of such souvenir and novelty items in advance of their sale which approval shall <br />not be unreasonably withheld, and which shall be directed to assuring that the souvenir and <br />novelty items sold are not substantially similar to Team souvenir and novelty items. The Team <br />shall have no responsibility for the collection and payment of any sales taxes due or payable <br />incidental to such sales, and the Park Board shall indemnify and hold harmless the Team for any <br />claims concerning sales tax due or payable as a result of such sales. <br />Section 6.05 COMPLIANCE WITH STATE AND LOCAL RULES AND <br />REGULATIONS. The Team shall assure that the Food and Beverage Service Areas are <br />operated in a clean and healthy manner and in compliance with all rules, regulations, statutes and <br />ordinances. <br />Section 6.06 COMPLIANCE WITH STATE ALCOHOLIC BEVERAGE STATUTES <br />AND REGULATIONS. The Team shall assure that the provision of Food and Beverage <br />Services is in compliance with all statutes and regulations concerning the sale of alcoholic <br />beverages. The compliance of the Food and Beverage Service Areas with all statutes and <br />regulations concerning the sale of alcoholic beverages shall be the responsibility of the Park <br />Board. <br />Section 6.07 LICENSES AND PERMITS. The Team is responsible to assure that all <br />applicable state and /or local permits and licenses for the provision of Food and Beverage <br />Services in the Stadium, with the exception of the Indiana Alcoholic Beverage Permit referred to <br />herein, will be obtained either directly or, during the period of the Team's agreement with a food <br />and beverage provider. During the term of this Stadium Agreement, the Park Board will <br />maintain an Indiana Alcoholic Beverage Permit for the sale of alcoholic beverages in the <br />Stadium. <br />Section 6.08 VENDING MACHINES. The Park Board reserves the right to approve the <br />location, extent and use of vending machines provided either directly by the Team or pursuant to <br />the Team's contract with a food and beverage provider. The Team acknowledges that it is the <br />Park Board's desire that vending machines be used to appropriately supplement the provision of <br />Food and Beverage Services rather than too substitute for the provision of said services in the <br />Stadium. <br />Section 6.09 QUALITY OF FOOD AND BEVERAGE SERVICES. The Team <br />acknowledges that the provision of high quality Food and Beverage Services in a manner <br />pleasing to the public is of utmost importance to the overall success of the Stadium and at events <br />held in the Stadium. The Team shall take all reasonable efforts to assure that food is of high <br />quality and consistent with the goals of the Team and the Park Board to enhance attendance at all <br />events held in the Stadium. <br />Section 6.10 SERVICES TO SPECIALIZED SEATING AREAS. The Team in the <br />provision of Food and Beverage Services shall provide wait person Food and Beverage Services <br />to all Specialized Seating Areas. <br />
