Filing Requirements and Procedure <br />(aj A request for Director reconsideration and a petition for <br />appeal filed under the_ foregoing _provision must identify the <br />sRecific action or condition to which objection„ is made,, the legal <br />and factual basis for _ the objection attaching any documents <br />supporting sgpporting the objector's position, and the alternative condition or <br />result, if any, that the objector desires. <br />(b) A request for Director_ reconsideration and a_ petition for <br />appeal shall ,be deemed timely filed if delivered in person to the <br />Director's office in the case of a request for .reconsideration or the <br />Board's office in the case of petition for gpveal, or by electronic <br />transmission: or if sent bv:mail. it is host - marked on or before the <br />O If the Board fails to hold a hearir g on a„ petition for appeal <br />within thirty 30 days, or to render a decision within sixty 60 <br />days after the _filing of the petition the petition shall be deemed <br />denied. <br />Le) Judicial Review <br />Any person aggrieved by a_fiinal_ action of the Board of Public Works <br />under: <br />1 Section -17-10(d)(1) approvinp, or denying an application for an <br />individual wastewater discharge permit_ including any condition, <br />obligation, or limitation imposed by permit_under Section 17_10 or this <br />Section 17 -11 <br />21 Section 17 -1 ON) modifvina a permit or condition thereof: <br />3 Section 17 -10 r 2 3 4 or 5 reiecting wastes in whole or in part, <br />requiring retreatment of such wastes requiring_ flow equalization, <br />requiring a surcharge, or _disarm roving the design Qf any pretreatment plant <br />or equipment; or <br />4 Subsection (c)ffl of this Section 17 -11. <br />Shall be subject to judicial review by the filing of a complaint for review <br />of final agency action with the St. Joseph County, indiana Superior or <br />Circuit Court. <br />74 <br />
