REGULAR MEETING NOVEMBER 13, 2006 in developing programs and strategies, making capital expenditures, and setting annual budgets; and WHEREAS, the Area Plan Commission of St. Joseph County, Indiana is empowered to approve a comprehensive plan within its area of jurisdiction by provisions City Plan contained in the aforementioned Indiana Code and has approved by resolution and provided the Common Council of the City of South Bend with a favorable recommendation; and WHEREAS, the Common Council of the City of South Bend, Indiana has the authority to adopt a comprehensive plan if it finds the content and the Goals, Objectives, and Policies of the Plan to be appropriate and in the best interests of the community; and City Plan WHEREAS, the , which is attached hereto and incorporated herein, contains all the elements required by Indiana Code Section 36-7-4-502, and is appropriate and in the best interest of South Bend and its citizens. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: City Plan SECTION I: That the 20 year comprehensive plan, , a true and complete copy of which is attached hereto and incorporated herein and which incorporates all non- substantive revisions requested by the City Administration on October 23, 2006, shall be and hereby is approved. SECTION II: That this Resolution shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. s/Timothy A. Rouse Member of the Common Council Vice-President Kelly noted that this bill in being heard in the Council portion only. Councilmember Pfeifer made a motion to consider the substitute version of this bill. Councilmember Dieter seconded the motion which carried by a voice vote of eight ayes. Councilmembers Varner, Kelly, Kirsits, Kuspa, Dieter, Pfeifer, and Puzzello offered their comments and thanked the members of the Civic Alliance, the Department of Community and Economic Development and all the citizens that participated in this process. Councilmember Puzzello made a motion to adopt this Resolution. Councilmember Dieter seconded the motion which carried and the Resolution was adopted by a roll call vote of eight (8) ayes. RESOLUTION NO. 3658-06 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING A PETITION OF THE SOUTH BEND BOARD OF ZONING APPEALS FOR THE PROPERTY LOCATED AT 828 & 830 E. FOX STREET, SOUTH BEND, INDIANA Whereas, Indiana Code Section 36-7-4-918.6, required the Common Council to give notice pursuant to Indiana Code Section 5-14-1.5-5, of its intention to consider Petitions for the Board of Zoning Appeals for approval or disapproval; and 14
