FROM EAST RIGHT-OF-WAY OF WILBUR ST. TO WEST RIGHT-OF- <br />WAY OF BIRDSELL ST. <br />Mr. Gilot indicated that John Pollard, 425 Birdsell St., South Bend, IN 46628, has submitted a <br />request to vacate the above referenced alley. Mr. Gilot advised the Board is in receipt of <br />unfavorable recommendations concerning this Vacation Petition from the Community <br />Investment and Engineering Departments who state the petitioner is not the owner of record for <br />the property and the vacation would not allow access to the property from Wilber St. <br />Engineering and Community Investment state the alley width is insufficient for a driveway also. <br />Attorney McDaniels stated she reviewed Indiana Code and Indiana Ordinance and both stated <br />that you have to be a property owner contiguous or adjacent to an alley to petition for a vacation. <br />She stated the criteria is not met here. She asked if it is certain this petitioner is not the property <br />owner. Ms. Maradik stated that based on the tax records system, they don't own any property, <br />nor do they have a land contract on any. Mr. Gilot stated this is not a valid application and even <br />if it was, it received unfavorable recommendations. He noted the petition has no standing <br />according to Indiana Code and therefore, Mr. Gilot made a motion rejecting the petition. Ms. <br />Maradik seconded the motion, which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the following <br />traffic control device was approved: <br />NEW INSTALLATION: Reserved Handicap Parking Permit No. 5 <br />APPLICANT: Jean Samolczyk <br />LOCATION: In Front of County -City Building <br />REMARKS: All criteria has been met <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE —18116 CLOVERLEAF DRIVE S. — SEWERIWATER <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Village Contractors, Inc., 2010 Went Avenue, Mishawaka, IN <br />46545. The Consent indicates that in consideration for permission to tap into public <br />water/sanitary sewer system of the City, to provide water/sanitary sewer service to the above <br />referenced property at 18116 Cloverleaf Drive S. (Key No. 002-1015-030544), the applicant <br />waive(s) and release(s) any and all right to remonstrate against or oppose any pending or future <br />annexation of the property by the City of South Bend. Therefore, Ms. Maradik made a motion <br />that the Consent be approved. Ms. Fritzberg seconded the motion, which carried. <br />E <br />
