Councilmember Varner seconded <br />the motion which carried by a voice vote of eight (8) ayes. <br />BILL NO. 24-07 PUBLIC HEARING ON A BILL OF THE COMMON <br />COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING ORDINANCE NO. 9708-06 WHICH <br />ANNEXED TO AND BROUGHT WITHIN THE CITY <br />LIMITS OF SOUTH BEND, INDIANA, CERTAIN <br />LAND IN GERMAN TOWNSHIP, CONTIGUOUS <br />THEREWITH; COUNCILMANIC DISTRICT NO. 1, <br />FOR THE SOLE PURPOSE OF CORRECTING A <br />SCRI VENER' S ERROR <br />Councilmember Kirsits, Chairperson, Zoning & Annexation, reported that this committee <br />held a Public Hearing on this bill this afternoon and voted to send it to the full Council <br />with a favorable recommendation. <br />Nicholas Witwer, Community & Economic Development, 12~` Floor County-City <br />Building, made the presentation for this bill. <br />Mr. Witwer advised that this bill amends Ordinance No. 9708-06 to correct a scrivener's <br />error. The bill inadvertently referred to the property being annexed as a portion of the <br />parcel located at 25401 Brick Road. Although the parcel was refereed to as 25401 Brick <br />Road in the tax records, the land records indicate the address is actually 52097 Olive <br />Road. The address 25401 Brick Road is used to describe an adjacent parcel. The <br />annexing ordinance provided a correct common description and legal description and <br />clearly identified the annexed property as being along the southwest corner of the <br />intersection of Brick Road and Olive Road. The same family owns the 25401 Brick Road <br />parcel that owns 52097 Olive Road parcel, but they wanted to have the scrivener's error <br />officially clarified to prevent any tax or boundary confusion in the future. <br />Kathleen Cekanski-Farrand, Council Attorney, advised that the legal description was <br />correct. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable <br />recommendation to full Council concerning this bill.
