Area Board of Zoning Appeals - Apri17, 2010 <br />neighborhood. They. rent homes across the street. They own vacant property that's not well maintained right <br />across the street frazn this. The property looks in worse shape then my property does when I took it over. So <br />I just wanted to share that. I'm happy to visit with anybody or answer any questions. I would hope that you <br />would pass this on with a favorable recommendation. The issue is not the duplex. The duplex will be there <br />for decades to come. The investment has been made. The issue is whether a new single family home will be <br />an impraveznent to the neighborhood and the streetscape and to the lifestyle. <br />MR. URBANSKI: Any questions from the Board or staff? <br />SOMEONE FROM THE AUDIENCE WANTED TO SPEAK AGAIN <br />MR. URBANSKI: Normally you can only speak one time. Please speak at the microphone Phil because it's <br />being recorded. <br />MR. PHIL BYRD: I would agree with the gentleman here that the new construction might not be the issue, <br />the issue is the duplex and to go from anon-conforming use to give it Special Use Exception forever is one <br />of our primary objections. We do not want that structure to get Special Use Exception, period. <br />MR. VELLEMAN: You all hope that it will never be a duplex is what I'm understanding, is that right? <br />MR. BYRD: It's a duplex now. <br />MR. VELLEMAN: You'll all holding out hope that one year it won't get rented out and it will revert back? <br />MR. BYRD: It will revert back, yes. <br />MR. VELLEMAN: Do you think that's a realistic objective? <br />MR. BYRD: Who knows. Who knows. If you vote and grant the Special Use, we know it will always be <br />that way. <br />MR. FEDDER: Mark, do want to add something? <br />MR. MARK LYONS: Just a real quick point of clarification. The duplex is one of the issues here because <br />as soon as you change the legal lot of record that that duplex sits on, as a legal non-confarrning use, if that <br />Special Use is not granted that duplex does have to cease to exist and can not he used. As soon as you <br />change the lot lines, it would lose it's legal non-conforming status. <br />MR. PAT MATTHEWS: I was not aware of that nor was I aware that was the issue that was standing in <br />their way. If it would appease them, I think they all recognize the investment has been made in the duplex as <br />it is, but if the issue is whether or not this duplex will 6e a duplex for the next 10(3 or i 50 years, even if it <br />remains vacant for several years, I would be happy to concede on that concession. That it would remain a <br />grandfathered unit and allow us to move forward. <br />$1 <br />
