Elmer Street, South Bend, IN 46628,
-have submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in
receipt of favorable recommendations based on IC 36-7-3-13 from the Area Plan Commission,
Police Department, Solid Waste, Community Investment and Engineering. Community
Investment recommends approval based on the condition it is accepted by the property owner at
902 N. Elmer St. Mr. Gilot advised the Board is in receipt of unfavorable recommendations
concerning this Vacation Petition from the Fire Department who stated, per IC 36-7-3-13, the
vacation would make access to the lands of the aggrieved person by means of public way difficult or
inconvenient. They noted the closest hydrant is 178 feet across the alley to be vacated. The next nearest
hydrants are 590', 581', and 545' to get to the structures at the cross of the alleys. The Fire Department is
concerned that their fire hose will not reach in the case of a fire.
Therefore, Ms. Fritzberg made a motion the Board give no recommendation, and the above
comments be forwarded to the Common Council for review.
