Tue. sday, June I7 th. , 1930, <br />filed against the Portage Avenue improvement.. Said report shows that 24 out of 26 <br />resident property owners had signed the remonstrance. This number constitutes a <br />majority and the Board, therefore, rescinds all former action t8.ken on said resolu- <br />tion and declares same null and void. and the proceedings closed. <br />City Bnpineer, T-1. G. Wray, filed the primary assessment rolls showing <br />the awards of damages and assessments of benefits in the matter of the following <br />Vacations resolutions: <br />I <br />Vacation of the alley W. of Pulaski 'itreet from Division Street to <br />• Alley south of Division Street under Vacation Resolution No.2323. <br />li <br />Vacation of the alley west of Brookfield Street from Division Street <br />to alley south of Division Street under Vacation Resolution No.2324. <br />I <br />Vacation of the alley west of Kosciuszko Street from Division Street <br />to alley` south of Division Street under Vacation Resolution No.2322. <br />In all of the above named assessront rolls, the Board hereby orders <br />that on the 9th., day of July I930, this Board will meet in their office in the City <br />Nail at 7-I5 P. M., to hear and receive remonstrances from all persons whose property <br />• has been affected by said vacations and. will decide whether the several lots and <br />parcels of land I-nve been or will be benefited or dame ged in the amounts shown on <br />said assessment rolls or in a greater or less sum than that shown on said rolls.. The <br />Board further orders that notices of said hearings together with the amounts of <br />i damages and benefits, be delivered to property owhers according to law. <br />i <br />This being the date set, for the filing of the plans, specifications <br />and. estimates as required by the Board under Modified Track Elevation esolution No. <br />5, the Board finds that said plans, specifications and estimates have been filed <br />by the New York Central Railroad, the Grand Trunk Western Railroad and the New Jersey <br />Indiana and Illinois Railroad Comp any. The Polling resolution was adopted: <br />i <br />• RESOLUTION <br />It now appearing to the Board that the New York Central Railroad Co., <br />The Grand Trunk Western Railroad Company and the New Jersey, Indiana and Illinois <br />Railroad Company and the City Civil Engineer of the City of South Bend, Indiana, did <br />file their plans, specifications and estimates uner Modified Track elevation Res- <br />olution No.S on June I7th. , I930,1 said date being within the time fixed by this Board <br />for the filing-, of same. <br />Resolved, that the Board now fixes the Ist., day of July I930 at I0:00 <br />A. M* q as a time at which said Board will receive and hear any and all remonstrances <br />• ! from persons interested in or affected by the improvement and the cost of the grade <br />separation as authorized by Grade Separation Resolution No.5 adopted on the 3rd. <br />day of January I930, and modified on the Ist., day of April f930, and the Clerk of <br />said Board is hereby directed to cause notice of said hearing, together with the fact <br />is that complete plans, specifications and estimates have now been filed in the office <br />of said Board, to be given as provided for by law. <br />, <br />M.
