Tue. sday, June I7 th. , 1930, filed against the Portage Avenue improvement.. Said report shows that 24 out of 26 resident property owners had signed the remonstrance. This number constitutes a majority and the Board, therefore, rescinds all former action t8.ken on said resolu- tion and declares same null and void. and the proceedings closed. City Bnpineer, T-1. G. Wray, filed the primary assessment rolls showing the awards of damages and assessments of benefits in the matter of the following Vacations resolutions: I Vacation of the alley W. of Pulaski 'itreet from Division Street to • Alley south of Division Street under Vacation Resolution No.2323. li Vacation of the alley west of Brookfield Street from Division Street to alley south of Division Street under Vacation Resolution No.2324. I Vacation of the alley west of Kosciuszko Street from Division Street to alley` south of Division Street under Vacation Resolution No.2322. In all of the above named assessront rolls, the Board hereby orders that on the 9th., day of July I930, this Board will meet in their office in the City Nail at 7-I5 P. M., to hear and receive remonstrances from all persons whose property • has been affected by said vacations and. will decide whether the several lots and parcels of land I-nve been or will be benefited or dame ged in the amounts shown on said assessment rolls or in a greater or less sum than that shown on said rolls.. The Board further orders that notices of said hearings together with the amounts of i damages and benefits, be delivered to property owhers according to law. i This being the date set, for the filing of the plans, specifications and. estimates as required by the Board under Modified Track Elevation esolution No. 5, the Board finds that said plans, specifications and estimates have been filed by the New York Central Railroad, the Grand Trunk Western Railroad and the New Jersey Indiana and Illinois Railroad Comp any. The Polling resolution was adopted: i • RESOLUTION It now appearing to the Board that the New York Central Railroad Co., The Grand Trunk Western Railroad Company and the New Jersey, Indiana and Illinois Railroad Company and the City Civil Engineer of the City of South Bend, Indiana, did file their plans, specifications and estimates uner Modified Track elevation Res- olution No.S on June I7th. , I930,1 said date being within the time fixed by this Board for the filing-, of same. Resolved, that the Board now fixes the Ist., day of July I930 at I0:00 A. M* q as a time at which said Board will receive and hear any and all remonstrances • ! from persons interested in or affected by the improvement and the cost of the grade separation as authorized by Grade Separation Resolution No.5 adopted on the 3rd. day of January I930, and modified on the Ist., day of April f930, and the Clerk of said Board is hereby directed to cause notice of said hearing, together with the fact is that complete plans, specifications and estimates have now been filed in the office of said Board, to be given as provided for by law. , M.
