sewer at a point different than the proposed sewer connection to the sanitary <br />sewer system. <br />3. Dilution Prohibition. No permittee shall ever increase the use of process water, <br />or in any way attempt to dilute a discharge as a partial or complete substitute for <br />adequate treatment to achieve compliance with a discharge limitation unless <br />expressly authorized by an applicable Pretreatment Standard or Requirement. <br />The Director may impose mass limitations on permittees who are using dilution <br />to meet applicable Pretreatment Standards or Requirements or in other cases <br />when the imposition of mass limitations is appropriate. <br />4. Right of Revision. The City reserves the right to establish by ordinance or in <br />individual wastewater discharge permits, more stringent standards or <br />requirements on discharges to the POTW consistent with the purpose of the <br />Pretreatment Program. <br />B. General Pretreatment Requirements <br />1. Power and Authority o Ins ectors <br />a. The Director, Inspector and other duly authorized employees of the City <br />bearing proper credentials and identification shall be permitted to enter all <br />properties for the purpose of inspection, observation, measurement, <br />sampling, and testing in accordance with the provisions of the City of South <br />Bend's Municipal Code. The Director or his representative shall have no <br />authority to inquire into any processes including metallurgical, chemical, <br />oil, refining, ceramic, paper or other industries that do not have a direct <br />bearing on the kind and source of discharge to the sewers or waterways of <br />facilities for waste treatment. <br />b. While performing the necessary work on private properties, the Director or <br />duly authorized employees of the City shall observe all safety rules <br />applicable to the premises established by the company and the company <br />shall be held harmless for injury or death to the City employees and the City <br />shall indemnify the company against loss or damage to its property by City <br />employees and against liability claims and demands for personal injury or <br />property damage asserted against the company and growing out of the <br />gauging and sampling operation, except as such may be caused by the <br />negligence or failure of the company to maintain safe conditions in their <br />facility. <br />c. The Director and other duly authorized employees of the City bearing <br />proper credential and identification shall be permitted to enter all private <br />properties through which the City holds a duly negotiated easement for the <br />purpose of, but not limited to, inspection, observation, measurement, <br />sampling, repair and maintenance of any portion of the sewage works lying <br />within said easement.
