REGULAR MEETING APRIL 24, 2017 <br /> PUBLIC HEARINGS <br /> BILL NO. <br /> 04-17 PUBLIC HEARING ON AN ORDINANCE <br /> AMENDING THE ZONING ORDINANCE FOR <br /> PROPERTY LOCATED AT 1248 AND 1258 N. <br /> TWYCKENHAM DRIVE, COUNCILMANIC <br /> DISTRICT NO. 4 IN THE CITY OF SOUTH <br /> BEND, INDIANA <br /> Councilmember Oliver Davis, Chair of the Zoning and Annexation Committee, reported that <br /> they met this afternoon and send this bill forward with a favorable recommendation, subject to <br /> written commitments. <br /> Angela Smith, Area Plan Commission, with offices on the l Itn Floor of the County-City <br /> Building, South Bend, IN, served as the presenter of this bill. Ms. Smith stated that the petitioner <br /> is seeking to rezone the property located at the intersection of Twyckenham Drive and SR 23. <br /> The property encompasses three (3) parcels, with two (2) that are immediately abutting SR 23 <br /> and one (1)that has direct frontage onto Twyckenham Drive. To the north, across SR 23, are <br /> properties zoned U, University. Ms. Smith stated that they are currently vacant. To the east, <br /> south, and west are single-family homes zoned, SF-1, Single-Family and Two (2)-Family <br /> District. Ms. Smith presented to the Council public images depicting the two (2) single-family <br /> homes currently on the property, which have been proposed to be demolished and replaced by <br /> proposed. Ms. Smith presented another image with a view looking toward the commercial <br /> development at the point where Angela Boulevard becomes Edison Road(the full presentation is <br /> on file in the City Clerk's Office). Ms. Smith stated that the petitioner has just under an acre of <br /> property here and that they are seeking to put in nine (9) single-family townhomes. Ms. Smith <br /> explained, When you have more than two (2) dwellings attached to each other, it becomes a <br /> multi-family building. So, you'll see one (1) building that fronts on SR 23 that has three (3)units <br /> and then the other building along Twyckenham Drive has six(6)proposed units. Ms. Smith <br /> stated that the petitioners varied the front of the elevations to help provide some definition and <br /> some variation along the street frontage, with the southernmost two (2) units being set back a <br /> minimum of twenty (20) feet. She explained that this will help them blend in with the single- <br /> family residential to the south, which has a setback of at least twenty-five (25) feet. The <br /> petitioners are proposing three (3) land use written commitments that are attached with the <br /> report. She stated, One (1) is for the setback of those other two (2) units; the second is for <br /> potential future cross-access easement. If and when that property to the east ever developed, it <br /> does not require them to put it in—it just gives the property owner to the east the option to divide <br /> that access, if they so choose; the third deals with not locating any buildings behind the ones that <br /> you see here in the site plan. This comes to you from the Area Plan Commission with a favorable <br /> recommendation subject to those written commitments. Rezoning the property to MF-1, Urban <br /> Corridor and Multi-Family District to allow for the development of single-family townhomes <br /> will provide a buffer in transition from the University-related uses to the north to the single- <br /> family homes to the south. The strong urban design principles of the northeast neighborhood <br /> zoning overlay ensures that development is appropriately integrated into the whole character of <br /> the neighborhood. <br /> Mike Danch Hamer& Associates 1643 Commerce Drive South Bend IN served as the <br /> petitioner of this bill. Mr. Danch stated that his party is seeking to rezone the property to MF-1 to <br /> allow for the construction of nine (9) single-family attached townhomes. He stated that there is <br /> only one (1) access point for the site at the south end of the property, on Twyckenham Drive. He <br /> stated, All the buildings are going to be set back. We do have three (3) along South Bend <br /> Avenue. These are going to end up being on individual lots. There are six (6) along Twyckenham <br /> Drive. What we also asked for was a variance to adjust those setbacks to basically try to meld <br /> into the existing neighborhood. There is a house to the south that is back almost forty-five (45) <br /> feet. One (1) of the written commitments that we will end up with is to basically adjust those <br /> buildings from ten(10) feet back to twenty-five (25) feet back.
