101 <br />1 <br />REGULAR MEETING FEBRUARY 21, 1994 <br />APPROVE CORRECTIVE GRANT OF EASEMENT - NORTHERN INDIANA COMMUTER <br />TRANSPORTATION DISTRICT <br />Mr. Leszczynski noted that the City Attorney's office has <br />submitted a Corrective Grant of Easement to the Northern Indiana <br />Commuter Transportation District. It is further noted that the <br />original Grant of Easement was approved by the Board on January 4, <br />1994. The new Easement is required as the Northern Indiana <br />Commuter Transportation District previously provided to the City <br />an incorrect legal description. Mr. Leszczynski made a motion <br />that this new Corrective Easement be approved. Mr. Caldwell <br />seconded the motion which carried. <br />APPROVE APPLICATION AND AGREEMENT FOR ELECTRIC SERVICE - INDIANA <br />MICHIGAN POWER COMPANY - CORBY STREET LIFT STATION <br />The Board received an Application and Agreement for Electric <br />Service as submitted by Indiana Michigan Power Company for <br />electric service to the new lift station at Corby Boulevard. The <br />Agreement indicates that the City agrees to make a payment of <br />$744.00 for this service. Mr. Carl P. Littrell, Director, <br />Division of Engineering, noted that this Agreement, in the amount <br />of $744.00, is for the installation of a transformer bank and <br />underground service for the lift station. This will allow for <br />construction of the new line. Mr. Leszczynski made a motion that <br />this Application and Agreement for Electric Service be approved <br />and executed. Mr. Caldwell seconded the motion which carried. <br />APPROVE REVISION TO EMERGENCY BOARD UP SERVICE LIST <br />Assistant Fire Chief Bert R. Prawat, South Bend Fire Department, <br />recommended that the Board remove G.B.R. Investments, 1628 South <br />Michigan Street, South Bend, Indiana, from the Emergency Board -up <br />Services List and replace them with the next vendor on the waiting <br />list. Chief Prawat noted that G.B.R. Investments were called by <br />the Communications Center on seven (7) occasions and they could <br />not be reached or would not respond. Therefore, Mr. Caldwell made <br />a motion that G.B.R. Investments be removed from the list and the <br />next vendor on the waiting list be added to the rotating list <br />utilized by the Fire Department. Mr. Leszczynski seconded the <br />motion which carried. <br />DENY REQUESTS FOR RESTRICTED RESIDENTIAL PARKING• <br />- SOUTH SIDE OF HILDRETH STREET ONLY (1516 TO 1622 HILDRETH) <br />- NORTH AND SOUTH SIDES OF HILDRETH STREET (1601-1622 HILDRETH) <br />It was noted that the Board is in receipt of a Memorandum from <br />Mrs. Marcia Qualls, Division of Engineering, advising that the <br />above two (2) Petitions for Restricted Residential Parking did not <br />meet the criteria of the ordinance and therefore should be denied. <br />Mr. Vince Nagy, Bureau of Traffic and Lighting, reported that <br />requirements to satisfy the South Bend Municipal Code regarding <br />residential parking are as follows: <br />- Curb space must be occupied seventy-five (75%) of the time. <br />- Curb space must be occupied by non-resident vehicles at <br />least twenty-five (25%) per cent of the time. <br />In regards to the first Petition referenced above, twenty-nine per <br />cent (29%) of curb space was occupied and twenty-seven per cent <br />(27%) of the curb space was occupied by non-resident vehicles. <br />This Petition therefore does not meet the criteria of the <br />ordinance and must be denied. <br />With regards to the second Petition referred to above, thirty- <br />eight per cent (38%) of the curb space was occupied with twenty- <br />nine per cent (29%) of the curb space occupied by non-resident <br />
