REGULAR MEETING JULY 11995 <br />ATTEST: <br />s/Angela K. Jacob, Clerk <br />ADOPT RESOLUTION NO. 43-1995 - TRANSFER OF CITY OWNED PROPERTY TO THE <br />CITY OF MISHAWAKA <br />Upon a motion made by Mrs. Manier, seconded by Mr. Leszczynski and carried, the following <br />Resolution was adopted: <br />RESOLUTION NO. 43-1995 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS FOR THE <br />TRANSFER OF ONE (1) HUBER MAINTAINER FROM THE SOUTH BEND DIVISION OF <br />EQUIPMENT SERVICES TO THE CITY OF MISHAWAKA <br />WHEREAS, I.C. 36-1-11-8 governs the exchange of property by the City with another <br />governmental entity; and <br />WHEREAS, the City of South Bend Division of Equipment Services desires to donate the <br />following equipment to the City of Mishawaka, as this equipment is obsolete and no longer suited <br />for use in the motor vehicle fleet of the Department: <br />1980 HUBER MAINTAINER MODEL 850, VIN # M251 <br />WHEREAS, the City of Mishawaka is in need of this equipment to add to its motor vehicle <br />fleet and seeks the transfer by the South Bend Division of Equipment Services to it of said <br />equipment; and <br />WHEREAS, it is the desire of the City of South Bend Division of Equipment Services to <br />transfer said equipment to the City of Mishawaka. <br />NOW THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend that in consideration of the equipment transfer as set out above, the City conveys the following <br />Equipment to the City of Mishawaka: <br />1980 HUBER MAINTAINER MODEL 850 VIN # M251 <br />The transfer of said equipment shall be effective upon the adoption of a Resolution <br />substantially identical in its terms to the terms of this Resolution by the City of South Bend for St. <br />Joseph County. <br />WHEREAS, this equipment has already been declared obsolete by the Board pursuant to <br />Resolution No.42-1995, adopted on July 3, 1995. <br />BE IT FURTHER RESOLVED that said equipment be removed from the City inventory. <br />ADOPTED this 3rd day of July, 1995. <br />CITY OF SOUTH BEND <br />BOARD OF PUBLIC WORKS <br />s/John E.
