380 REGULAR MEETING SEPTEMBER 8. 1997 DENY SIDEWALK SALE PERMIT APPLICATION Mr. Caldwell indicated that the Board is in receipt of the following Sidewalk Sale Permit application: APPLICANT: Corby's Irish Pub BUSINESS ADDRESS: 1121 East Colfax Avenue DATES OF SALE: September 13-16, 1997 GOODS TO BE SOLD: Food and Drinks Mr. Caldwell made a motion that this application be denied. Ms. Roemer seconded the motion which carried. FAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as completed by Sally and William Grossnickle, 2503 Mishawaka Avenue, South Bend, Indiana to vacate the following alley: The first east -west alley north of Mishawaka Avenue from the east right of way of South 25th Street to the west right of way line of the first north south alley east of 25th Street for a distance of approximately 128 feet and a width of 12 feet. Part located in Berner Grove 1 st Addition, City of South Bend, St. Joseph County, Indiana. Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic Development and the Department of Public Works. Therefore, Mr. Caldwell made a motion that the Board send a favorable recommendation to the Common Council concerning this Vacation Petition. Mr. Littrell seconded the motion which carried. FILING OF APPLICATION FOR CERTIFICATE OF PUBLIC CONVENIENCE - HOOSIER CAB COMPANY Upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the Application for a Certificate of Public Convenience, as submitted by Mr. Harvey Lester James, 606 Hendricks Street, Mishawaka, Indiana, was filed. APPROVE TRAFFIC CONTROL DEVICE Upon a motion made by Mr. Littrell, seconded by Mr. Caldwell and carried, the following traffic control device was approved: Removal - Handicap Sign 11502 N. Brookfield I Signs are not needed FILING OF CERTIFICATES OF INSURANCE Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the following Certificates of Insurance were accepted for filing: HRP Construction Madison Center, Inc. Post Office Box 266 403 East Madison South Bend, Indiana 46624-0266 South Bend, Indiana 46617 APPROVE CLAIMS Ms. M. Catherine Roemer, City Controller, submitted claims in the amount of $709,526.52 dated September 8, 1997, and recommended approval. Additionally, Mr. Juan Manigault, Executive Director, WDS of Northern Indiana, submitted two (2) lists containing claims in the amount of $52,759.57 and $233,088.03 and recommended approval. Ms. Roemer made a motion that the claims be approved and the reports as submitted be filed. Mr. Littrell seconded the motion which carried.
