REGULAR MEETING MARCH 31, 1997 RESOLUTION 20-1997 RESOLUTION RELATING TO THE ACQUISITION OF REAL PROPERTY WHEREAS, it is deemed necessary and desirable by the South Bend Board of Public Works to acquire various easements across the real property identified in Attachments "A", "B", and "C" hereto, which real property is necessary for a sewer improvement. NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of Public Works as follows: 1. The City Engineer is authorized and directed to cause a notice and written offer to be made to the owner(s) of real property identified in Attachments "A", "B", and "C" hereto- (Real Estate), to purchase the Real Estate under the condition that the offering price shall not exceed the average of two (2) appraisals of the Real Estate procured by the South Bend Department of Public Works, 2. The appointment of appraisers is hereby ratified. Adopted at the Regular Meeting of the South Bend Board of Public Works held on March 31, 1997, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, IN 46601. Jacob, Clerk APPROVAL OF DEEDS OF DEDICATION Mr. Caldwell stated that the following Deeds of Dedication have been submitted to the Board for approval: Teresa Bova Key Number 18-8.153-5528 Locust Road Barbara Luckett Key Number 18-8153-5522 Locust Road Upon a motion made by Mr. Caldwell, seconded by Mr. Littrell and carried, the Deeds of Dedication were approved. APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Mr. Caldwell stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. and Mrs. Austin Hickey, 59600 S. Ironwood Road, South Bend, Indiana. The Consent"indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to 59600 South Ironwood Road, South Bend, Indiana, (Key # 14-1167-6187), the Hickey's waive and release any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Ms. Roemer made a motion that the Consent be approved. Mr. Caldwell seconded the motion which carried. APPROVE CONSENT TO _ANNEXAT.ION AND WAIVER OF RIGHTS TO REMONSTRATE W. Caldwell stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. and Mrs. Barry Painter. The Consent indicates that in consideration for permission to tap into the public sanitary sewer system of the City, to provide sanitary sewer service to 54450 30th Street, South Bend, Indiana, South Bend, Indiana, (Key # 02-2053-2135), the Painter's waive and release any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Ms. Roemer made a motion that the Consent be approved. Mr. Caldwell seconded the motion which carried. 1 i
